PRE-ADOPTION NEWSPAPER NOTICE
NOTICE
TOWN OF TRIADELPHIA
Notice is hereby given that the Town of Triadelphia, a municipal corporation, will hold a hearing before the final vote on a proposed ordinance, the principal object of which is the increase of water rates for customers of the water system operated by the Town of Triadelphia. The title of such ordinance is “An Ordinance of the Council of the Town of Triadelphia Adopting Increased Rates and Charges for Water Utility Service Provided by the Town of Triadelphia and Setting an Effective Date for Such Rates .”
The rates and charges being proposed are:

The Final vote on adoption of said proposed ordinance shall be held in the Council Chambers of the Town of Triadelphia, 4453 National Road, Triadelphia, West Virginia on Wednesday, August 4, 2021, at seven o’clock (7:00) p.m. Interested parties may appear and be heard at such time with respect to the passage of the proposed ordinance. Copies of the proposed ordinance are available at the Office of the Clerk, Town Hall, in Triadelphia.

AN ORDINANCE OF THE COUNCIL OF THE TOWN OF TRIADELPHIA ADOPTING INCREASED RATES AND CHARGES FOR WATER UTILITY SERVICE PROVIDED BY THE TOWN OF TRIADELPHIA AND SETTING AN EFFECTIVE DATE FOR SUCH RATES

WHEREAS, the Town of Triadelphia, a municipal corporation, through its Water Department, has a duty to provide quality water service to the residents and customers of the Town of Triadelphia; and

WHEREAS, the rates and charges for such water service are required by law to be just, reasonable, nondiscriminatory, non-preferential and based primarily on costs of service; and

WHEREAS, the Council of the Town of Triadelphia finds that in order to maintain the operation of the Town Water System at efficient levels, to comply with West Virginia Public Service Commission requirements and to comply with provisions of the Water Revenue Bond Ordinance of the Town, it is necessary to increase the rates and charges for the Water Utility Service.

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE TOWN OF TRIADELPHIA:

Section 3.101 of the Code of the Town of Triadelphia shall be amended and as of the effective set forth hereafter water rates shall be amended, revised, replaced with full substitution by the following rates and charges of Water Service to customers of the Town:

WATER RATES
APPLICABLE IN THE ENTIRE TERRITORY SERVED

AVAILABILITY OF SERVICE
Available for domestic and commercial service, and for fire protection service.

RATE
First 3,000 $13.55 per 1,000 gallons
Next 3,000 $12.60 per 1,000 gallons
Next 4,000 $11.64 per 1,000 gallons
Next 90,000 $10.52 per 1,000 gallons
Next 900,000 $9.17 per 1,000 gallons
All Over 1,000,000 $7.90 per 1,000 gallons

MINIMUM CHARGE
No bill will be rendered for less than the following amounts, according to the size of the meter installed, to wit:

5/8 inch meter $ 40.65 per month
3/4 inch meter $40.65 per month
1 inch meter $106.82 per month
2 inch meter $409.60 per month
3 inch meter $921.14 per month
4 inch meter $1,077.73 per month

No bill will be rendered for less than forty dollars and sixty-five cents ($40.65) per month.

DELAYED PAYMENT PENALTY
The above schedule is net. On all accounts not paid in full within twenty (20) days of date of bill, ten percent (10%) will be added to the net amount shown.

RECONNECTION CHARGE
When water service has been disconnected for non-payment of bill or fraudulent use of water, water service shall not be restored until all past due water bills and penalties have been paid in full and a reconnection charge in the amount of twenty-five dollars ($25.00) has been paid.

TAP FEE
A service connection fee (Tap Fee) in the amount of five hundred dollars ($500.00) shall be charged for all new water connection installations with 5/8″ or 3/4″ meter. A service connection fee (Tap Fee) in the amount of six hundred fifty dollars ($650.00) shall be charged for all new water connection installations with a 1″ meter. The service connection fee for any line greater than 1″ shall be charged based upon labor time and materials used.

SALES FOR RESALE
All water for resale will be billed in accordance with the approved rate per thousand gallons paid to the City of Wheeling for water purchased from them plus three dollars and twenty-five cents ($3.25) per 1,000 gallons.

LEAK ADJUSTMENT
Three dollars and thirty-five cents ($3.35) per 1,000 gallons of water is to be used when the bill for water or sewage reflects unusual water consumption which can be attributed to eligible leakage on the customer’s side of the meter. This rate shall be applied to all such consumption above the customer’s historic average use.

RETURNED CHECK CHARGE
A charge of up to twenty-five dollars ($25.00), not to exceed the actual returned check fee charged by the bank, will be made for all checks returned by the bank as the result of non-sufficient funds.

EFFECTIVE DATES:
The rates, fees, charges, delayed payment penalty charges, service connection fee and the fees for disconnection and reconnection of water service provided herein shall be effective forty-five (45) days after the adoption of this ordinance.

FILING REQUIREMENTS
The Mayor of the Town of Triadelphia shall file the rates and charges adopted by this Ordinance with the Public Service Commission of West Virginia together with such information showing the basis of such rates and charges as the Commission deems necessary; and take all of the action necessary and as required by law to effectuate this Ordinance to increase the Water Rates as provided by the Town of Triadelphia in this Ordinance.
