NOTICE OF TRUSTEE’S SALE
NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated December 7, 2005, executed by Borrower(s), Deborah G Collis, Louise C Collis and Stephen P Collis, to James B. Crawford, III, the Trustee of record in the office of the Clerk of the County Commission of Berkeley County, West Virginia, in Book 1818, at Page 478. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 1905 Gerrardstown Road, Gerrardstown, WV 25420. Pill & Pill, PLLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated April 16, 2020, of record in the Clerk’s Office in Book 3489, Page 666. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Berkeley County, in Martinsburg, West Virginia, on the following date:
September 20, 2021 at 10:00 a.m.
All that certain lot or parcel of real estate, together with the improvements and appurtenances thereunto belonging, situate, lying and being in the Town of Gerrardstown, Berkeley County, West Virginia, more particularly bounded and described as follows:
PARCEL NO. 1: Beginning at the southwest corner of lot owned by Jno. Griffith’s heirs on the north side of main street in said town; thence running north with the line of said Griffith to the northeast corner of same and in line of W.S. Coe’s locust grove; thence with said Coe’s line east 33 ft. to a stake; thence south on a straight line to a point on said main street 33 feet east of said first corner; thence along the line of said main street west 33 feet to the beginning, containing one-fourth acre, more or less.
PARCEL NO. 2: Beginning at a corner in the Ivey Lee Price line; thence running S.E. 10 feet to a new corner in the Robert Price line; thence with his line 167 feet N.E. to a corner in the George M. Bowers line; thence with his line N.W. 10 feet to a corner in the Ivey Lee Price line and corner to George M. Bowers; thence with the Ivey Lee Price line S.E. 167 feet to the beginning, containing 1/10 of an acre, more or less.
TOGETHER WITH a right of way to said land hereby conveyed from the main road, running N.E. 10 feet wide and 79 feet long.
Being the same property conveyed to Stephen P Collis, Deborah G. Collis, and Louise C. Collis, by the Deed dated 02/07/1992 and recorded in Deed Book 492 at Page 619 in the Office of the Clerk of the County Commission of Berkeley County, West Virginia.
TERMS OF SALE:
1) The property will be conveyed is an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, Liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West
Virginia § 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance whall be in the sole discretion of the Trustee.
5). The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF
ACCORDINGLY.
6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
