The West Virginia Department of Environmental Protection, Division of Water and Waste Management, hereby proposes to renew the Class D General Permit, Permit Number SWF-GP-NC- CLASS D, to regulate noncommercial construction / demolition materials generated by noncommercial construction / demolition activities. The Class D General Permit authorizes the disposal of construction / demolition waste in an area no greater than two (2) acres in spacial area in which the height of construction / demolition material may not exceed the height of the adjoining ground elevation. The Class D Solid Waste Facility is defined by 33CSR1 “Solid Waste Management Rule”. The Class D General Permit will be issued for a five (5) year term.

The Director of the Division of Water and Waste Management retains authority to require any registrant to obtain an individual solid waste permit. This authority will be exercised when the Director determines that such individual permit will better protect human health and/or the environment.

Interested persons may submit written comments during the 30-day public comment period, which begins on September 8, 2021 and ends on October 8, 2021, to the following address:

Comments received within this time period will be considered prior to any state action on the subject permit. Correspondence should include the name, address, and telephone number of the writer and a concise statement of the nature of the issues addressed.

The draft permit will be on file for public review during the comment period at the West Virginia Department of Environmental Protection, Division of Water and Waste Management, Solid Waste Management, 601 57th Street SE, Charleston, WV 25304.
