Notice is hereby given that the undersigned Trustee, will sell at public auction to the highest bidder on:

February 10, 2016,
at 10:00 a.m.,

at the front door of the Marshall County Courthouse, 600 7th Street, Moundsville, West Virginia, that certain property conveyed by William Jeffery Earley and Carrie Ann Earley, husband and wife, to James C. Gardill, Trustee, by Deed of Trust dated March 14, 2002, and recorded in the office of the said Clerk of the County Commission of Marshall County, West Virginia, in Deed of Trust Book 660, at page 402, and being described as follows:

The following described property situate in the Washington District, Marshall County, West Virginia, and being more particularly bounded and described as follows, to-wit:

Beginning at a point on the west side of a 45 foot right-of-way, known as Hidden View Drive, said point being located the following seven (7) courses along said right-of-way line from the southeast corner of a 0.640 acre tract conveyed to Grant Douglas Richards and Kerri Sue Richards by deed dated the 19th day of September, 2001, as recorded in Deed Book 623, Page 192 of the Marshall County records:

S 03* 41′ 33″ W 74.10 feet to a point, thence S. 24* 26′ 58″ W 385.59 feet to a point, thence with a curve to the left, having a radius of 522.50 feet for an arc length of 75.09 feet, the chord for said arc being S. 20* 19′ 57″ W 75.02 feet to a point, thence S. 16* 12′ 56″ W 201.73 feet to a point, thence S 16* 42′ 10″ W 77.0 feet to a point thence with a curve to the right, having a radius of 277.50 feet for an arc length of 119.84 feet, the chord for said arc being S. 29* 04′ 29″ W 118.91 feet to a point, thence S 41* 26′ 48″ W 96.95 feet to said place of beginning, being the beginning point of the lots hereby conveyed, thence continuing with said right-of-way S. 41* 26′ 48″ W 33.50 feet to a point, thence with a curve to the left, having a radius of 93.47 feet an arch length of 126.43 feet, the chord for said arc being, S 02* 41′ 50″ W 117.01 feet to a point, thence with a curve to the right having a radius of 20.0 feet, an arc length of 21.01 feet, the chord for said arc being S 05* 57′ 20″ E 20.06 feet to a point, thence S 24* 08′ 30″ W 110.0 feet to a point, thence leaving said right-of-way and running through the lands of Blake (Deed Book 591, Page 18) N 52* 57′ W 216.0 feet to an iron pin, thence N 16* 14′ 06″ E 154.71 feet to an iron pin, thence, N. 53* 00′ 13″ E 84.88 feet to an iron pin, thence S 62* 55′ 47″ 148.17 feet to the place of beginning, containing 1.082 acres, more or less, according to a survey by Chadan Engineering in December, 2001. Being all of Lots 36 and 37 as shown on a plat of Grand View estates, Phase II and not yet of record.

This conveyance is made subject to the fourteen (14) restrictive covenants or conditions listed in Deed Book 626, at page 196.

This conveyance is, however, subject to the exceptions, reservations, covenants, conditions, restrictions and easements, if any, granted by or acquired from the parties of the first part and their predecessors in title to said land.

Being the same property conveyed to W. Jeffery Earley and Carrie Ann Earley, his wife, from William E. Blake and Kandee L. Blake, his wife, by Deed dated February 13, 2002, and of record in the Office of the Clerk of the County Commission of Marshall County, West Virginia, in Deed Book 626, Page 196.

The terms of the sale will be as follows: Cash in hand on the day of sale. Sale of said property will be made subject to: (1) All prior exceptions, reservations, rights of ways easements, conditions, covenants, restrictions, leases and other servitude’s of record if any pertaining to said real estate: (2) any and all unpaid taxes assessed against said property: (3) The subject property will be sold in “as is” condition: (4) The Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property: (5) The Trustee will deliver a Trustee’s Deed to the purchaser without any covenant or warranty (expressed or implied) in the form prescribed by West Virginia Code Chapter 38-1-6. The Trustee makes no representations and warranties about the title of the real estate to be conveyed.

Any sale hereunder may be adjourned from time to time without notice other than oral proclamation at the time and place appointed for the sale. The Trustee reserves the right to reject any or all bids. Additional terms and conditions shall be announced at the sale.

Any sale hereunder in which the property is encumbered by Federal Tax Liens will be subject to the 120 day redemption period pursuant to 26 U.S.C.A. Section 7424(d).
