Notice is hereby given that the undersigned Substitute Trustee, appointed by document dated January 12, 2016, and of record in the Office of the Clerk of the Wetzel County Commission in Deed of Trust Book 393 at page 392, will sell at public auction to the highest bidder on:
February 18, 2016,
at 10:00 a.m.,
at the front door of the Wetzel County Courthouse, 200 Main Street, New Martinsville, West Virginia, that certain property conveyed by Michael Renshaw to Ronal W. Rush, Trustee, by Deed of Trust dated February 8, 2013, and recorded in the office of the said Clerk of the County Commission of Wetzel County, West Virginia, in Deed of Trust Book 364, at page 155, and being described as follows:
The following described property with the appurtenances thereunto belonging, situate in Proctor District, Wetzel County, West Virginia, that is to say:
Three (3) certain lots or parcels of land, situate in Cresap’s Addition to the Village of Proctor, Proctor District, Wetzel County, West Virginia, and being Lots Number One (1), Two (2) and Three (3) in said Addition, as laid down, designated and described on the recorded plat of said Cresap’s Addition of record in the Office of the Clerk of the County Commission of Wetzel County, West Virginia, to which plat reference is here made for a more particular description of said property.
There is EXCEPTED and RESERVED from the above described property a parcel of land containing .093 of an acre, more or less, heretofore conveyed to the State Road Commission of West Virginia, a corporation, by deed dated the 14th day of August, 1956, and recorded in the Wetzel County Clerk’s Office in Deed Book 205, page 443.
This conveyance is made subject to all reservations, exceptions, grants of rights of way and easements made by the grantors and their predecessors in title as recorded in the said Wetzel County Clerk’s Office.
Being the same property conveyed to Michael Renshaw by Mary Lou Athey by deed dated January 31, 2013, and recorded in Wetzel County Deed Book 433, at page 475.

The terms of the sale will be as follows: Cash in hand on the day of sale. Sale of said property will be made subject to: (1) All prior exceptions, reservations, rights of way, easements, conditions, covenants, restrictions, leases and other servitudes of record if any pertaining to said real estate; (2) any and all unpaid taxes assessed against said property; (3) the subject property will be sold in “as is” condition; (4) the Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property; (5) the Substitute Trustee will deliver a Substitute Trustee’s Deed to the purchaser without any covenant or warranty (expressed or implied) in the form prescribed by West Virginia Code Chapter 38-1-6. The Substitute Trustee makes no representations and warranties about the title of the real estate to be conveyed.
Any sale hereunder may be adjourned from time to time without notice other than oral proclamation at the time and place appointed for the sale. The Substitute Trustee reserves the right to reject any or all bids. Additional terms and conditions shall be announced at the sale.
