Notice is hereby given that the undersigned Substitute Trustee, appointed by document dated January 12, 2016, and of record in the Office of the Clerk of the Wetzel County Commission in Deed of Trust Book 393 at page 393, will sell at public auction to the highest bidder on:

at 10:15 a.m.,
at the front door of the Wetzel County Courthouse, 200 Main Street, New Martinsville, West Virginia, that certain property conveyed by Frank D. Giovinazzo to Ronal W. Rush, Trustee, by Deed of Trust dated September 16, 2013, and recorded in the office of the said Clerk of the County Commission of Wetzel County, West Virginia, in Deed of Trust Book 368, at page 373, and being described as follows:
The following described property with the appurtenances thereunto belonging, situate in New Martinsville, Wetzel County, West Virginia, that is to say:
Being all of lot Number Forty-four (44) in the South Gate Subdivision to the City of New Martinsville, Magnolia District, Wetzel County, West Virginia, as laid down, designated and described on the recorded plat of said subdivision, which plat was recorded in the office of the Clerk of the County Commission of Wetzel County, West Virginia, in Plat Book 3, pages 30 and 31, to which plat reference is here made for a more particular description of said lot.
This conveyance is subject to the restrictive covenants and conditions as set forth in deed dated December 13, 1966, and recorded in the said Wetzel County Clerk’s Office in Deed Book 240, page 381.
This conveyance is subject to all other reservations, exceptions, grants of rights of way and easements made by the grantors and their predecessors in title as recorded in the said Wetzel County Clerk’s Office.
Being the same property conveyed to Frank D. Giovinazzo by Blanche B. Bailey by deed dated January 13, 2004, and recorded in Wetzel County Deed Book 390, at page 34.

The terms of the sale will be as follows: Cash in hand on the day of sale. Sale of said property will be made subject to: (1) All prior exceptions, reservations, rights of way, easements, conditions, covenants, restrictions, leases and other servitudes of record if any pertaining to said real estate; (2) any and all unpaid taxes assessed against said property; (3) the subject property will be sold in “as is” condition; (4) the Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property; (5) the Substitute Trustee will deliver a Substitute Trustee’s Deed to the purchaser without any covenant or warranty (expressed or implied) in the form prescribed by West Virginia Code Chapter 38-1-6. The Substitute Trustee makes no representations and warranties about the title of the real estate to be conveyed.
Any sale hereunder may be adjourned from time to time without notice other than oral proclamation at the time and place appointed for the sale. The Substitute Trustee reserves the right to reject any or all bids. Additional terms and conditions shall be announced at the sale.
