TRUSTEE’S SALE
NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated June 12, 2014, executed by Borrowers, Damion R. Saunders and Shannon M. Saunders, to Capital Funding Title Agency, the Trustee of record in the office of the Clerk of the County Commission of Ohio County, West Virginia, in Book 1488, at Page 478. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 143 Springdale Avenue, Wheeling, WV 26003. Pill & Pill, PLLC was appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated January 8, 2016, of record in the Clerk’s Office in Book 1518, Page 767. The borrowers defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Ohio County, in Wheeling, West Virginia, on the following date:
February 17, 2016
at 12:03 p.m.
The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Triadelphia (Wheeling) District, Ohio County, West Virginia, and being more particularly described as follows:
the following described property, that is to say:
All of the two lots or parcels of ground and being described as Lots Numbered Fifteen (15) and Seventeen (17) as designated on the map of the plat of lots, streets and alleys known as Springdale in Triadelphia District, Ohio County, West Virginia, which said plat is recorded in the office of the Clerk of the County Commission of Ohio County, West Virginia, in Plat Book No. 1 at page 178, and to which reference is hereby made for a more particular description of said lots. The coal underlying said property is excepted and reserved and not hereby conveyed. There are excpeted and reserved from this conveyance all such mining rights privileges as may have heretofore been conveyed.
It is further convenanted, provided and agreed that the said parties of the second part, their heris and assigns shall not erect a dwelling house or place of business upon said property that shall cost less than the sum of $1,500.00 and further that the said parties of the second part, their heirs and assigns shall not erect any building except an open porch, piazza or stoop upon said property, and portion of which is nearer than Sixteen (16) feet from the front line of said property.
Said parties of the first part do hereby grant unto the said parties of the second part the right to use of the sewer laid upon and across the lot of ground hereby conveyed. The grant of the property herein is made subject, however, to the right of drainage through said sewer by the respective owners of several lots in the said plat of Springdale. The above descirbed property is commonly known as: 143 Springdale Avenue, Wheeling, WV 26003.
Being the same property conveyed to Damion R. Saunders and Shannon M. Saunders by the Deed dated June 5, 2014 and recorded in Deed Book 875, at Page 453 in the Office of the Clerk of the County Commission of Ohio County, West Virginia.
TERMS OF SALE:
1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code Section 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6)The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale.
