NOTICE OF TRUSTEE’S SALE
NOTICE OF TRUSTEE’S SALE is hereby given
pursuant to and by virtue of the authority vested in the
Substitute Trustee, Pill & Pill, PLLC, by that certain
Deed of Trust dated September 21, 2001, executed by
Borrower(s), Billy Alan Moore and Michelle M Moore, to
W. Brad Sorrells, the Trustee of record in the office of
the Clerk of the County Commission of Wetzel County,
West Virginia, in Book 271, at Page 685 and
re-recorded in Book 275, at Page 255. At the time of
the execution of the Deed of Trust, this property was
reported to have a mailing address of Rt 1 Trader Run,
Folsom, WV 26348. Pill & Pill, PLLC were appointed as
Substitute Trustees by APPOINTMENT OF
SUCCESSOR TRUSTEE dated June 25, 2021, of
record in the Clerk’s Office in Book 438, Page 778. The
borrower(s) defaulted under the Note and Deed of Trust
and the Substitute Trustees have been instructed to
foreclose under the Deed of Trust. Accordingly, the
Substitute Trustees will sell the following described
property to the highest bidder at the front door of the
Courthouse of Wetzel County, in New Martinsville, West
Virginia, on the following date:
November 5, 2021 at 10:40 a.m.
All that certain lot or parcel of land on Trader Run Road
and Trader Run near the mouth of Chicarello Hollow
Run in Grant District, Wetzel County, West Virginia,
more particularly bounded and described as follows:
BEGINNING at a ½” rod set on the west side of
a driveway at a corner to land remaining to Billy Joe
Moore, then with and binding on land remaining to Billy
Joe Moore for seven lines, N. 60* 59′ W. 161.80 feet to
a set 1/2″ rod; thence N. 29* 53′ E. 172.65 feet to a set
1/2″ rod; thence S. 77* 38′ E. 147.55 feet to a set 1/2″
rod; thence N. 83* 42′ E. 34.53 feet to a nail set in the
center of Trader Run Road; thence S. 77* 38′ E. 179.93
feet to a point; thence S. 13* 14′ W. 271.14 feet to a
point; thence N. 66′ 39′ W. 257.81 feet (passing through
the center of a nail set in the center of Trader Run
Road) to the beginning, containing 2.00 acres, more or
less, and as set forth on a plat or survey thereof
prepared by Henry M. Parsons, P.S. No. 98, dated
September 11, 2001, a copy of which is incorporated
herein for all pertinent purposes. And being part of a
57.40 acre parcel of land that was conveyed unto Billy
Alan Moore and Connie Jo Moore, brother and sister, by
Billy Joe Moore and Carolyn Louise Moore, husband
and wife, by deed dated January 30, 1990, and found of
record in the Office of the Clerk of the County Commi
sion of Wetzel County, West Virginia, at Deed Book
373, page 225. By deed dated September 14, 2001, and
recorded at Book 373, Page 372 the said Billy Joe
Moore and Connie Jo Moore conveyed their respective
interests in said 2.0 acre parcel unto Billy Alan Moore.
This deed of trust was previously recorded in the Office
of the Clerk of the County Commission of Wetzel
County, West Virginia, at Trust Deed Book 271, page
685.
TERMS OF SALE:
1) The property will be conveyed in an “AS IS” physical
condition by Deed containing no warranty, express or
implied, subject to the Internal Revenue Service right of
redemption, all property taxes, prior Deeds, liens,
reservations, encumbrances, restrictions,
rights-of-ways, easements, covenants, conveyances
and conditions of record in the Clerk’s office or affecting
the subject property.
2) The Purchaser shall be responsible for the payment of
the transfer taxes imposed by the West Virginia Code
§11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of
Trust and Note reserve the right to submit a bid for the
property at sale.
4) The Trustee reserves the right to continue sale of the
subject property from time to time by written or oral
proclamation, which continuance shall be in the sole di
cretion of the Trustee.
5) The Trustee shall be under no duty to cause any
existing tenant or person occupying the property to
vacate said property, and any personal property and/or
belongings remaining at the property after the
foreclosure sale will be deemed to constitute
ABANDONED PROPERTY AND WILL BE DISPOSED
OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee
within thirty (30) days of the date of sale, with ten (10%)
of the total purchase price payable to the Trustee at
sale.
