NOTICE OF
SUCCESSOR TRUSTEE’S SALE
Notice is hereby given, by virtue of the authority vested in the undersigned Successor Trustees, Jordan V. Palmer and R. Douglas Calderwood, by that certain Deed of Trust made by William L. Rose and Jean S. Rose, dated May 22, 1998 and recorded May 26, 1998 in the office of the Clerk of the County Commission of Ohio County, West Virginia in Trust Deed Book 1049 at page 704, the said Successor Trustees acting by virtue of that certain Appointment of Successor Trustee dated September 8, 2021 and recorded September 29, 2021 in the aforesaid Clerk’s office in Substitute Trustee Book 1637, at page 718, and default having been made in the payment of the Note secured by the aforesaid Deed of Trust, and having been requested in writing by the owner and holder of the Note, will offer for sale, at public auction, to the highest bidder at the front door of the Courthouse of Ohio County, West Virginia, on November 18, 2021 at 1:00 p.m., all that certain lot, piece or parcel of real property, together with improvements thereon, situate in Wheeling, Wheeling District, Ohio County, West Virginia, being more particularly bounded and described as follows:

The following described property, that is to say:

A parcel of land consisting of Lot Three (3) and the northwesterly 8.6 feet of Lot Two (2) in Square “C” of I. J. Linton’s Subdivision of parts of Lots “Q”, “R” and “K” of the Subdivision of the Shepherd Estate in the Town of Elm Grove, now in the City of Wheeling, in Triadelphia District, Ohio County, West Virginia, as shown by a plat of same filed by I. J. Linton and recorded in the office of the Clerk of the County Court of Ohio County in Plat Book No. 1, at page 15, which said parcel is more particularly bounded and described as follows:

Beginning at the most northern corner of said Lot Three (3) on the southwesterly side of Chambers (formerly Virginia) Street and at the most easterly corner of Lot Four (4) in said plat which was conveyed by the said parties of the first part to Bessie M. Shanley by deed dated June 13, 1951 and recorded in said Clerk’s Office in Deed Book 334, page 129; thence with the southwesterly side of said Chambers Street in a southeasterly direction 48.6 feet to the most northerly corner of the parcel of land which was conveyed by Joseph J. Byrne and wife to Robert L. Ward and wife by deed dated June 9,1951 and recorded in said Clerk’s office in Deed Book 334, page 124; thence in a southwesterly direction along the line of said Ward property and parallel with the southeasterly line of said Lot Three (3) 100 feet to a point in the northeasterly side of Alley B, as shown on said plat, at the rear of said property; thence with the northeasterly side of said Alley B in a northwesterly direction 48.6 feet to a stake in the most southerly corner of said Lot Four (4); thence in a northeasterly direction with the division line between said Lots Three (3) and four (4) 100 feet to the place of beginning.

At the time of execution of the deed of trust, the grantor represented that the address of the property was 48 Chambers Avenue, Wheeling, WV 26003.

TERMS OF SALE: The Premises will be sold “AS IS, WHERE IS,” in its present condition and with all faults and defects, if any. The property will be conveyed by deed with no covenants of warranty of title. The property shall be sold subject to all liens not discharged by the sale, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges and liens with priority to the Deed of Trust pursuant to which this sale is being conducted. The property shall be sold subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s office or visible upon the ground. The property will be sold for cash in hand on the date of sale to the highest bidder. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamps to be affixed to the deed). The Successor Trustees and United Bank shall not be responsible for the removal of any person or personal property from the Premises.

Pursuant to the Deed of Trust, the Successor Trustees may postpone the sale by public announcement at the time and place designated and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the Premises at such sale.
