Notice is hereby given that the undersigned Substitute Trustee, appointed by document dated February 16, 2016, and of record in the Office of the Clerk of the Marshall County Commission in Deed of Trust Book 980, at page 174, will sell at public auction to the highest bidder on:
March 24, 2016,
at 10:00 a.m.,
at the front door of the Marshall County Courthouse, 600 Seventh Street, Moundsville, West Virginia, that certain property conveyed by Hun K. Choi and Angelica S. Choi to Ronal W. Rush, Trustee, by Deed of Trust dated September 9, 2014, and recorded in the office of the said Clerk of the County Commission of Marshall County, West Virginia, in Deed of Trust Book 948, at page 53, and being described as follows:
A parcel of real estate situated in McMechen District, Marshall County, West Virginia, as shown on the Marshall County Assessor’s Tax Map number 2, parcel numbers 29 and 28, bounded and described as follows:
PARCEL ONE:
Lot Number Nine (9) and the north one-half (1/2) of Lot Number Ten (10) designated and shown upon the Plat of Schafer Heirs Addition to McMechen, Marshall County, West Virginia, which said plat is recorded in the Office of the Clerk of the County Commission of Marshall County, West Virginia, in Deed Book No. 125, at pages 384 and 385.
PARCEL TWO:
The south one-half (1/2) of Lot Number Eight (8) of, and as the same is shown and described upon a plat of, the Schafer Heirs Addition to McMechen, Union District, Marshall County, West Virginia, which said plat is of record in the Office of the Clerk of the County Commission of Marshall County, West Virginia, in Deed Book 125 at page 384, and which said one-half (1/2) of said Lot Number Eight (8) fronts twelve and one-half (12-1/2) feet on the east side of Lincoln Street of said City of McMechen and extends, with equal width, in an easterly direction therefrom, one hundred thirty (130) feet, more or less.
This conveyance is made subject to the exceptions, reservations, covenants, conditions, restrictions, and easements, if any, granted by or acquired from the party of the first part and his predecessor in title to said property.
Being the same property conveyed to Hun K. Choi and Angelica S. Choi, his wife, by James V. George, by deed dated September 9, 2014, and recorded in Marshall County Deed Book 838, at page 490.

The terms of the sale will be as follows: Cash in hand on the day of sale. Sale of said property will be made subject to: (1) All prior exceptions, reservations, rights of way, easements, conditions, covenants, restrictions, leases and other servitudes of record if any pertaining to said real estate; (2) any and all unpaid taxes assessed against said property; (3) the subject property will be sold in “as is” condition; (4) the Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property; (5) the Substitute Trustee will deliver a Substitute Trustee’s Deed to the purchaser without any covenant or warranty (expressed or implied) in the form prescribed by West Virginia Code Chapter 38-1-6. The Substitute Trustee makes no representations and warranties about the title of the real estate to be conveyed.
Any sale hereunder may be adjourned from time to time without notice other than oral proclamation at the time and place appointed for the sale. The Substitute Trustee reserves the right to reject any or all bids. Additional terms and conditions shall be announced at the sale.
