NOTICE OF TRUSTEE’S SALE
NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated February 14, 2003, executed by Borrower(s), Rebecca L Haley, to McCamic, Sacco and Pizzuti, PLLC, the Trustee of record in the office of the Clerk of the County Commission of Ohio County, West Virginia, in Book 1178, at Page 99. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 312 N Huron St, Wheeling, WV 26003. Pill & Pill, PLLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated October 26, 2021, of record in the Clerk’s Office in Book 1646, Page 336. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Ohio County, in Wheeling, West Virginia, on the following date:

A certain parcel of land situated on the east side of North Huron Street, between Kentucky and New Jersey Streets, on Wheeling Island, Madison District, Wheeling, Ohio County, West Virginia, and occupied by a frame dwelling now known as No. 312 North Huron Street, said parcel comprising parts of Lots Numbered Twenty-one (21) and Twenty-two (22), in Square Numbered Eight (8), of John P. Gilchrist`s Addition to said City of Wheeling, a plat of said Addition being recorded in the office of the Clerk of the County Court of Ohio County, West Virginia, in Deed Book No. 55, page 101, said parcel hereby conveyed being bounded and described as follows: Beginning at a point in the east line of North Huron Street, which point is located S. 22 degrees 00` W. 20 and 1/100 feet from the intersection of the division line of Lots Numbered Twenty-two (22) and Twenty-three (23), in said Square Numbered Eight (8) with the east line of North Huron Street; thence from said point of beginning, S. 68 degrees 35` E. 100 feet to a stake in the west line of a parcel of land conveyed by Oscar Sandrock and wife to Frederick Retzer, by deed dated May 21, 1875, and recorded in the County Clerk`s Office in Deed Book No. 63, page 369; thence with the west line of said Retzer parcel, S. 22 degrees 00` W. 20 feet to a stake; thence leaving said Retzer parcel and with a line that is parallel to and ten inches distant, measured at right angles, in a northeasterly direction from both the northwest and the northeast cornerstrips of the frame dwelling house now known as No. 310 North Huron Street, N. 68 degrees 36` W. 100 feet to a stake in the east line of North Huron Street; thence with the east line of North Huron Street, N. 22 degrees 00` E. 20 and 1/100 feet to the place of beginning. BEING the same property conveyed to Anthony M. Malatinsky and JoAnne Malatinsky, his wife, from John J. Zeppuhar and Karin Zeppuhar, his wife, by deed dated November 5, 1984, and recorded in the aforesaid Clerk`s Office in Deed Book No. 622, page 295. The said Anthony M. Malatinsky departed this life on January 21, 1990, leaving his wife as the joint tenant with right of survivorship. By deed dated the 14th day of March, 1991, and recorded in the aforesaid Clerk`s Office in Deed Book No. 659, page 589, JoAnne H. Malatinsky, widow, conveyed the said property to JoAnne H. Malatinsky, widow, and Brenda L. Vickers, single. Brenda L. Vickers is now known as Brenda L. MacEwan. This conveyance is made subject to exceptions, reservations, restrictions, covenants, conditions, easements and rights-of-way referred to or contained in this deed, any aforementioned deeds and all prior conveyances of record.
Being the same property conveyed to Rebecca L Haley by the Deed dated February 4, 2003 and recorded in Deed Book 740 at Page 386 in the Office of the Clerk of the County Commission of Ohio County, West Virginia.
TERMS OF SALE:
1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code Section 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
