Situated In Richland District, Ohio County, West Virginia and being more particularly bounded and described as follows:
Beginning at a point at the most northerly corner of the 37 and 25/100 acre tract of land which was conveyed by Mary A. Waddell, widow, et al., to Wendell Burns and Charlotte Burns, his wife, by deed dated April 1, 1965, and recorded in the Office of the Clerk of the County Commission of Ohio County, West Virginia, in Deed Book 483, at Page 237, and the most westerly corner of the 14 and 93/100 acre tract of land (of which the hereindescribed (tract is a part), was conveyed by Bernard L. Kain and Jane Ola Kain, his wife, by deed dated August 31, 1954, and recorded in said County Clerk’s Office in Deed Book 353, at Page 149; thence from said beginning point along an original line of the said 14 and 93/100 acre tract, North 40′ 49′ East 153 and 57/100 feet to an iron pin: thence leaving said original line and with other lands now owned by the party of the first part hereto, South 58* 19′ East 399 and 68/100 feet to a point in the centerline of a roadway fifteen (15) feet wide: thence with said centerline the following two (2) bearings and distances; South 64′ 39′ East 147 and 34/100 feet to an iron pin; thence South 69* 10′ East 52 and 23/100 feet to a point; thence leaving said centerline of the fifteen (15) feet wide roadway, North 09′ 32′ East 24 and 11/100 feat ea a point at the most westerly corner of a 1 acre tract of land now or formerly owned by Ralph Salter and the northerly line of a roadway thirty (30) feet wide leading to the Wheeling, West Liberty and Bethany Pike Road; thence with said northerly line of roadway and the southerly line of the said 1 acre tract, South 45 11′ East 123 and 73/100 feet to a point; thence leaving said 1 acre tract and following along original lines of said 14 and 93/100 acre tract the following three (3) bearings and distances; South 09 32′ West 50 and 52/100 feet to a point at the most easterly corner of the said 37 and 25/100 acre tract; thence with same the following two (2) bearings and distances: South 52′ 07′ West 395 feet to a point; thence North 39* 08′ West 655 and 5/10 feet to the place of beginning, containing by survey made by Stegman & Schelihase, Inc Civil Engineers and Surveyors, four and eight hundred fifty-three one thousandths (4 and 85311000) acres, more or less.
There is excepted and reserved from the above-described tract of land the thirty (30) feet wide roadway and that part of the fifteen (15) feet wide roadway that is included within the boundary lines of the said 4 and 853/1000 acre tract of land, said roadways to be used in common by both parties hereto, their heirs and assigns.
There is also granted to the party of the second part hereto the right to use the thirty (30) feet wide roadways, as shown on the map of a portion of the Ridgeley Farm, west of Bethany Pike, said map being recorded in said County Clerk’s Office in Deed Book 261, at Page 206, leading from the Wheeling, West Liberty and Bethany Pike (W.Va. State Route 88), as shown on said map to the easterly line of the above described 4 and 853/1000 acre tract of land.
At the time of the execution of the Deed of Trust, this property was reported to have an address of: 118 Laurelwood, Wheeling, WV 26003.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
