NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given
pursuant to and by virtue of the authority vested in the
Substitute Trustee, Pill & Pill, PLLC, by that certain
Deed of Trust dated November 7, 2007, executed by
Borrower(s), Stephen M Snyder, to Carl H. Cather, III,
Esq. the Trustee of record in the office of the Clerk of
the County Commission of Wetzel County, West
Virginia, in Book 335, at Page 471. At the time of the
execution of the Deed of Trust, this property was
reported to have a mailing address of 22 Spielers Dr,
Proctor, WV 26055. Pill & Pill, PLLC were appointed as
Substitute Trustees by APPOINTMENT OF
SUCCESSOR TRUSTEE dated January 6, 2022, of
record in the Clerk’s Office in Book 442, Page 383. The
borrower(s) defaulted under the Note and Deed of Trust
and the Substitute Trustees have been instructed to
foreclose under the Deed of Trust. Accordingly, the
Substitute Trustees will sell the following described
property to the highest bidder at the front door of the
Courthouse of Wetzel County, in New Martinsville,
West Virginia, on the following date:

May 27, 2022 at 11:13 a.m.

The following described property, with the
appurtenances thereunto belonging, situate in Proctor
District, Wetzel County, West Virginia, that is to say:
Beginning at a 5/8″ x 30″ capped rebar, set, in a line of
the Spielers, Inc. (First Tract Deed Book 210, page 409)
and at a corner to a new 0.08 acre tract, thence with
said new tract and a new division line through Garnet R.
McCrady`s 0.30 acre tract (Deed Book 326, page 373);
N 64 14` W passing a 5/8″ x 30″ capped rebar, set, at
81.33 feet, 123.03 feet in all to a 5/8″ x 30″ capped
rebar, set, in the east right of way line of a 30 foot wide
old county road, thence with said east right of way line;
N 25 30` E 75.60 feet to a point in said east right of way
line, at a corner to said Spielers, Inc. (Second Tract
Deed Book 210, page 409), thence with said Spielers,
Inc.; S 64 30` E 125.40 feet to a point in a line of said
Spielers, Inc. Second Tract at a corner to Spielers, Inc.
First Tract, thence with said First Tract; S 27 17` W
76.09 feet to the point of beginning, containing 0.22
acre, more or less, as surveyed by C. Booth PS# 2036
in September, 2007 as shown on a plat
attached hereto.

This conveyance is made subject to all reservations,
exceptions, grants of rights of way and easements
made by the grantors and their predecessors in title as
recorded in the said Wetzel County Clerk`s Office.

Being the same property conveyed to Stephen M.
Snyder by the Deed dated November 7, 2007 and
recorded in Dee Book 411 at Page 175 in the Office of
the Clerk of the County Commission of Wetzel County,
West Virginia.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical
condition by Deed containing no warranty, express or
implied, subject to the Internal Revenue Service right of
redemption, all property taxes, prior Deeds, liens
reservations, encumbrances, restrictions,
rights-of-ways, easements, covenants, conveyances
and conditions of record in the Clerk’s office or affecting
the subject property.

2) The Purchaser shall be responsible for the payment
of the transfer taxes imposed by the West Virginia
Code § 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of
Trust and Note reserve the right to submit a bid for the
property at sale.

4) The Trustee reserves the right to continue sale of the
subject property from time to time by written or oral
proclamation, which continuance shall be in the sole
discretion of the Trustee.

5) The Trustee shall be under no duty to cause any
existing tenant or person occupying the property to
vacate said property, and any personal property and/or
belongings remaining at the property after the
foreclosure sale will be deemed to constitute
ABANDONED PROPERTY AND WILL BE DISPOSED
OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee
within thirty (30) days of the date of sale, with ten (10%)
of the total purchase price payable to the Trustee at
sale.
