NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given
pursuant to and by virtue of the authority vested in the
Substitute Trustee, Pill & Pill, PLLC, by that certain
Deed of Trust dated January 30, 2011, executed by
Borrower, John M Blind, to J.W. St. Clair and William
Levine, the Trustees of record in the office of the Clerk
of the County Commission of Tyler County, West
Virginia, in Book 179, at Page 589. At the time of the
execution of the Deed of Trust, this property was
reported to have a mailing address of 3010 Wick Rd,
Middlebourne, WV 26149. Pill & Pill, PLLC were
appointed as Substitute Trustees by APPOINTMENT
OF SUCCESSOR TRUSTEE dated May 5, 2021, of
record in the Clerk’s Office in Book 113, Page 205. The
borrower defaulted under the Note and Deed of Trust
and the Substitute Trustees have been instructed to
foreclose under the Deed of Trust. Accordingly, the
Substitute Trustees will sell the following described
property to the highest bidder at the front door of the
Courthouse of Tyler County, in Middlebourne, West
Virginia, on the following date:

May 27, 2022 at 11:50 a.m.

All that certain parcel of land lying and being in the
County of Tyler and State of West Virginia, more
particularly described as follows:

Beginning at a point on the Eastern line of the Allen H.
Butch Property; Thence with said Butch N. 68 degrees
48′ E. 248.76 feet to a point; Thence through the
property of David Lee and Joyce Stevens for eight new
lines: S. 15 degrees 43′ E. passing a 4-inch Sourwood
at 22.32 feet, 108.76 feet in all to a 70-inch White Oak;
Thence S. 47 degrees 00 W 151.80 feet to a 6-inch
hickory; Thence S. 41 degrees 18′ W. 98.00 feet to a
24- inch White Oak; Thence S. 13 degrees 36′ W. 71.18
feet to a point in the center of West Virginia Secondary
Route 7/8; Thence with the center of said West Virginia
Secondary Route 7/8 for two lines N. 14 degrees 12 W.
67.28 feet to a point; Thence N. 34 degrees 00′ W.
54.10 feet to a point; Thence N. 68 degrees 04′ E. 35.83
feet to a 16-inch White Oak; Thence N. 21 degrees 56′
W. passing a 4-inch Black Oak at 130.97 feet, 148.43
feet in all to the place of beginning and containing 0.94
acres, more or less, as surveyed by Richard E. Kinder,
Jr., of Eagle Surveying Inc., South Charleston, West
Virginia, and shown on plat attached hereto and made
part of this description.

Being the same property conveyed to John M Blind by
the Deed dated January 30, 2011 and recorded in Deed
Book 381 at Page 438 in the Office of the Clerk of the
County Commission of Tyler County, West Virginia.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical
condition by Deed containing no warranty, express or
implied, subject to the Internal Revenue Service right of
redemption, all property taxes, prior Deeds, liens,
reservations, encumbrances, restrictions,
rights-of-ways, easements, covenants, conveyances
and conditions of record in the Clerk’s office or affecting
the subject property.

2) The Purchaser shall be responsible for the payment
of the transfer taxes imposed by the West Virginia Code
ยง 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of
Trust and Note reserve the right to submit a bid for the
property at sale.

4) The Trustee reserves the right to continue sale of the
subject property from time to time by written or oral
proclamation, which continuance shall be in the sole
discretion of the Trustee.

5)The Trustee shall be under no duty to cause any
existing tenant or person occupying the property to
vacate said property, and any personal property and/or
belongings remaining at the property after the
foreclosure sale will be deemed to constitute
ABANDONED PROPERTY AND WILL BE DISPOSED
OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee
within thirty (30) days of the date of sale, with ten (10%)
of the total purchase price payable to the Trustee at
sale.
