By virtue of that certain Deed of Trust made by Ronald J. Muth, Jr. to John E. Gompers, Trustee, dated the 17th day of November, 2011, and of record in the office of the Clerk of the County Commission of Ohio County, West Virginia, in Deed of Trust Book No. 1425, at page 457, and that certain Appointment of Successor Trustee, dated the 3rd day of May, 2022, and of record in the aforesaid County Clerk’s office in Deed of Trust Book No. 1655, at page 211, the undersigned will sell at public auction, and subject to the terms and conditions set forth in this Trustee’s Notice of Sale and in the said Deed of Trust, on the 8th day of June, 2022, at 10:00 o’clock A.M., at the northwest front door of the Court House of Ohio County, Wheeling, West Virginia, the following described property (“Property”) situate at 2129 Marshall Avenue, Wheeling, Ohio County, West Virginia 26003, and being more particularly described as follows:
A certain piece or parcel of ground situated in what is known as the Simms Addition to the Town of Patterson, in Ohio County, West Virginia and fronting on the north side of the north line of Howell Street or Howell Avenue, and more particularly bounded and described as follows, to-wit:
The property hereby conveyed is known and designated on the unrecorded plat of the Simms Addition to the Town of Patterson, as lot number Seven (7) and described as follows: Beginning at the southwest corner of lot number Six (6) and two hundred and eighty-four (284) feet west of the corner of the Anthony Dusch – A. Allen Howell lot, in the north line of Howell Avenue, and thence running with said north line of the said Avenue or Street, north 87 degrees 35 west twenty-six (26) feet to the southeast corner of lot number Eight (8); thence leaving the line of Howell Avenue or Street and running with the line of lot number Eight (8) north 3-1/4 degrees west one hundred and thirty-eight (138) feet to a line which is twelve feet from the line of lands of Anthony Dusch, or the south line of an alley running along the Dusch line to Wheeling Creek; thence running with the south line of said alley, south 87 degrees 35 east twenty-six (26) feet to the northwest corner of lot number six (6); thence running with the west line of lot number Six (6) south 3-1/4 degrees west one hundred and thirty-eight (138) feet to the place of beginning, together with all the buildings and improvements thereon, or the appurtenances thereto belonging.
Being the same property conveyed to RB Muth, L.L.C., a West Virginia limited liability company, by deed from Thomas Edward Adams and Amanda Jo Adams, his wife, dated June 29, 2006 and of record in the Office of the Clerk of the County Commission of Ohio County, West Virginia in Deed Book 770 at page 91.
TERMS OF SALE: Sale of the Property will be made subject to the lien for any and all real estate taxes, whether or not currently due, owing, delinquent or payable, whether paid or are otherwise not currently payable, and further, sale of the subject interest in the Property is subject to any and all other liens, encumbrances, or adverse claims of interest which may be superior to the lien of the Deed of Trust being foreclosed upon or the title of Successor Trustee hereunder. The Property will be conveyed “As Is”, without warranty or representation, express or implied, as to title, physical condition, environmental condition or any other adverse condition which might affect merchantability, marketability, fitness or use of the Property. CASH IN HAND or CERTIFIED FUNDS (Certified Check) in full in the amount of the successful bid or bids on the day of the sale is required for any bidder to purchase the subject Property.
