NOTICE OF SALE
UNDER DEED OF TRUST

Notice is hereby given that, under authority of a certain deed of trust hereinafter described, the undersigned Substitute Trustee will, at the front door of the Randolph County Courthouse, in Elkins, West Virginia, on

August 10, 2022
11:00 a.m.

offer for sale certain property described in that certain deed of trust executed by VERDA M. DAVISON to John E. Busch and David E. Thompson, as Trustees, which deed of trust is dated the 15th day of September, 2006, and of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Trust Deed Book 417, at Page 408; and given to secure Davis Trust Company, the payment of a note therein described.

By Substitution of Trustee dated April 15, 2019, and of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Trust Deed Book 574, at Page 488, Jennifer L. Morgan was appointed Substitute Trustee, and which said property is described as follows:

All those two (2) certain lots, parcels or tracts of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Crystal Springs, on the north side of Locust Avenue, Leadsville District, Randolph County, West Virginia, and more particularly bounded and described as follows:

Parcel A: BEGINNING at an iron pipe on the north side of said Avenue, from which an iron pipe is 92.0 feet westerly, a 10″ apple tree is 5.25 feet northeasterly and the center of a water meter lid is northerly 12.85 feet, thence with land of Alex Goldberg, a little east of north 110.0 feet to an iron pipe, thence easterly 58.5 feet to an iron pipe from which a double white walnut is southwesterly 29.5 feet, a 2″ red oak is 12.3 feet southwesterly and a 2-1/2″ hickory is 6.9 feet westerly, thence a little west of south 108.0 feet to an iron pipe in the north line of Locust Avenue, from which the southeast corner of a concrete block house foundation is northwesterly 25.4 feet and the wood post southwest corner of a house is northeasterly 28.0 feet, thence with said Avenue, westerly 55.0 feet to the beginning, containing 6,162 square feet or 0.141 acre, more or less.

Parcel B: BEGINNING at an iron pipe on the north edge of Locust Avenue in Crystal Springs, corner to Parcel A, thence with said Locust Avenue westerly 45.0 feet to a point, thence leaving said Avenue and with Goldberg’s reserved land northeasterly 112.2 feet to a point, thence easterly 40.0 feet to an iron pipe, corner to Parcel A, thence with Parcel A southwesterly 110.0 feet to the beginning, containing 4,160 square feet or 0.109 acre, more or less.

And being the same real estate conveyed to Arthur J. Davison and Verda M. Davison, husband and wife, by virtue of a deed from Charles J. Sturm and Betty J. Sturm, his wife, said deed dated the 24th day of December, 1975, and of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Deed Book 298, at Page 239. The said Arthur J. Davison having later died on the 16th day of February, 1999, intestate, and by the provisions of the survivorship clause in said deed, subject real estate vested solely in his wife, Verda M. Davison.

Verda M. Davison subsequently died August 5, 2014, and pursuant to her Last Will and Testament dated April 27, 1988, and probated August 20, 2014, in Will Book 53 at page 755, she devised the above-described real estate to her son, William J. Davison.

This conveyance is made subject to any and all reservations, restrictions, exceptions, rights-of-way and easements as set forth in prior instruments of record in the chain of title to said real estate.

The above-described property will be sold subject to all reservations, restrictions, exceptions and conditions contained in all prior deeds conveying said real estate except those pertaining to race, color or creed, and subject to all unpaid levies and assessments including real estate taxes. TERMS OF SALE: Cash in hand on day of sale, or ten percent (10% down), or approved line of credit with closing to occur within thirty (30) days. Purchaser accepts subject real estate “AS IS”.

The undersigned Substitute Trustee reserves the right to reject any and all bids received, and to continue said sale from time to time, upon announcement thereof given verbally, on day of sale and any continuance thereof.
