SALE OF REAL ESTATE
The City of Weirton Sanitary Board, who determined that the hereinafter described property was no longer needed for sanitary purposes or for any purpose connected with the operation of the sanitary system, except for an easement to be reserved to it, will offer for sale at public auction at the front door of its offices at 5000 Freedom Way, Weirton, West Virginia, on
August 5, 2022 at 12:00 Noon
the following lot or parcel of real estate, with its improvements and appurtenances thereunto belonging, situate on LaFayette Circle, Hindman Estates, Weirton (Tax Map No. W43F, Parcel 0075) containing approximately .24 acres, more or less, and more particularly described as follows:
ALL that certain lot or parcel of real estate, situate in the City of Weirton, District of Butler, County of Hancock and State of West Virginia, known, referred to and designated by Lot Number, as Lot Number Thirty-eight (38), in a plan of lots entitled “Revised Plat of Hindman Estates Subdivision Allotment No. 1”, a plat of which lot is of record in the office of the Clerk of the County Court of Hancock County, West Virginia, in Plat Book No. 4, at Page Nos. 150-151; Reference to which is made for a further, complete and exact description of the lot conveyed herein (the “Property”).
The conveyance of the Property will be made subject to any and all exceptions, reservations, restrictions, covenants, conditions or stipulations that are contained in or referred to in the conveying deed and all prior deeds of record and also to any and all rights of ways or easements of record, including an easement in favor of the City of Weirton Sanitary Board, which will be set forth in the conveyance deed to the buyer, and more particularly described as follows:
A sanitary sewer line easement that leads from an existing manhole located within the right of way for Lexington Circle, then proceeding through a portion of Lot No. 38. The following described easement parcel is parallel to and distant by 10.00 feet from the existing sewer line and represents that portion which is included within Lot No. 38. Bounded and being more particularly as follows.
Beginning for the same at an iron bar set in the easternmost margin of Lexington Circle at its intersection with the division line between Lot No. 38 and the 20.00 foot right of way as defined upon a plat entitled “The Preliminary And Final Plan Of Hindman Estates Allotment No. Six” of record in the Office of the Clerk of the County Commission of Hancock County, West Virginia in Plat Cabinet Slide 41-A.
Thence, from the said place of beginning, leaving the said easternmost margin of Lexington Circle, and now with the said division line, N. 81 degrees 11′ 56″ E. for a distance of 125.00 feet to an iron bar found at the most eastern corner of Lot No. 38 as shown upon the above referenced plan. Thence, and now with a line that is parallel to and 10.00 feet distant from the said existing City Of Weirton Sanitary Board, sanitary sewer line, through Lot No. 38, and with the most northerly line of the herein described easement parcel, S. 87 degrees 03′ 36″ W. for a distance of 133.60 feet to a point that is located upon the aforementioned easternmost margin of Lexington Circle. Thence, with the same, with a curve to the right, the said curve having a radius of 62.00 feet, having a central angle of 14 degrees 34′ 30″, the chord bearing and distance for the said arc being S. 38 degrees 52′ 46″ E. for a distance of 15.77 feet to the place of beginning, containing 269 square feet, more or less, as per survey by Bryan A. Payne, West Virginia Registered Land Surveyor No. 977.
BEING a part of the same parcel of land defined as Lot No. 38 as shown upon “The Preliminary And Final Plan Of Hindman Estates Allotment No. Six” recorded in Cabinet Slide 41-A, that was conveyed from Strip Steel Community Federal Credit Union, fka, Strip Steel Employees Federal Credit Union, to the City Of Weirton Sanitary Board, by a deed dated on the 26th day of October, 2005 and is recorded in the Office of the Clerk of the County Commission of Hancock County, West Virginia in Deed Book 275 at Page 388.
TERMS: Cash on date of sale to the highest bidder, or if the City of Weirton Sanitary Board so elects, one-third (1/3) of the purchase money on the day of sale, and the residue within twenty (20) days from the day of sale, or any other such terms as the City of Weirton Sanitary Board deems appropriate; and, that the sale may be adjourned from time to time without other notice than oral proclamation at the time and place appointed for selling from which adjournment is made. Notwithstanding anything stated to the contrary in this notice, the City of Weirton Sanitary Board reserves the right to accept any bid or reject any and all bids, even the highest bidder, at its meeting on August 11, 2022. The subject property will be sold in a “AS IS” condition.
