By virtue of that certain Deed of Trust made by Indian Point Properties, LLC to John E. Gompers, Trustee, dated the 22nd day of September, 2016, and of record in the office of the Clerk of the County Commission of Ohio County, West Virginia, in Deed of Trust Book No. 1532, at page 115, and that certain Appointment of Successor Trustee, dated the 12th day of May, 2022, and of record in the aforesaid County Clerk’s office in Deed of Trust Book No. 1656, at page 773, the undersigned will sell at public auction, and subject to the terms and conditions set forth in this Trustee’s Notice of Sale and in the said Deed of Trust, on the 2nd day of August, 2022, at 10:15 o’clock A.M., at the northwest front door of the Court House of Ohio County, Wheeling, West Virginia, the following described property (“Property”) situate at 40 S. Frazier Avenue, Wheeling, Ohio County, West Virginia 26003, and being more particularly described as follows:
The following described property situate in the City of Wheeling, Wheeling District, Ohio County, West Virginia, to-wit:
A certain piece or parcel of ground situate in Ritchie District (now Wheeling District), Ohio County, West Virginia, and being the south fifty-five (55) feet off of the land formerly owned by Otto Harold Peterson. The lot hereby conveyed fronts fifty-five (55) feet on the easterly side of County Road, and extends back an equal width to the easterly or back line of said Otto Harold Peterson land, which lot is more particularly described as follows, to wit: Beginning at a point in the easterly boundary line of the County Road, which point is the division line between the property formerly owned by Henry Rothermund and said Otto Harold Peterson, said point being two hundred twenty-five (225) feet north of a stake in the County Road, which is a corner to said Henry Rothermund and property formerly owned by George Bromer; thence in a northerly direction along the said eastern boundary line of said County Road, a distance of fifty-five (55) feet to a stake; thence in an easterly direction at right angles to said County Road and in a line parallel with said Henry Rothermund’s northerly line, a distance of two hundred twenty (220) feet, more or less, to a stake in the easterly line of said Otto Harold Peterson’s land; thence in a southerly direction with said last mentioned line a distance of sixty (60) feet, more or less, to the northerly line of said Henry Rothermund; thence in a westerly direction along said Henry Rothermund’s line, a distance of two hundred (200) feet, more or less, to the place of beginning.
This conveyance of the above described real estate is expressly made subject to the exceptions, reservations, covenants, conditions, restrictions and easements, if any there be, granted by or acquired from first party and the predecessors in title of said first party to said real estate.
Together with all improvements, easements, rights of way, water and sewage rights, appurtenances, and all fixtures now part of the above described real estate, if any there be, unless otherwise expressly excepted, reserved, qualified and/or shown ante, or anon.
TERMS OF SALE: Sale of the Property will be made subject to the lien for any and all real estate taxes, whether or not currently due, owing, delinquent or payable, whether paid or are otherwise not currently payable, and further, sale of the subject interest in the Property is subject to any and all other liens, encumbrances, or adverse claims of interest which may be superior to the lien of the Deed of Trust being foreclosed upon or the title of Successor Trustee hereunder. The Property will be conveyed “As Is”, without warranty or representation, express or implied, as to title, physical condition, environmental condition or any other adverse condition which might affect merchantability, marketability, fitness or use of the Property. CASH IN HAND or CERTIFIED FUNDS (Certified Check) in full in the amount of the successful bid or bids on the day of the sale is required for any bidder to purchase the subject Property.
