The object of the above entitled action is: the Plaintiff is seeking judgment against the Defendant in the amount of $3,775.40 plus court costs and interest for the Defendant’s alleged failure to perform the obligations of the original contract between the two parties.
And it appearing by an affidavit filed in this action that the Defendant was not served, either personally or by way of service upon an appropriate family member, after service was twice attempted by the Sheriff of the county in witch the defendant resided or was located.
It is ordered the Merle Williams, Jr. do serve upon the Plaintiff, Citizens Bank of West Virginia, at the above address, and the Honorable Tracy M. Harper, magistrate, whose address is 11 Randolph County, Elkins, West Virginia, an answer or other defense to the complaint filed in this action on or before September 20, 2022, otherwise judgment by default will be taken against Merle Williams, Jr. at any time thereafter. A copy of said complaint can be obtained from the undersigned Clerk at her office.
