UNDER DEED OF TRUST
Notice is hereby given that, under authority of a certain deed of trust hereinafter described, the undersigned Trustee will, at the front door of the Randolph County Courthouse, in Elkins, West Virginia, on
August 31, 2022
11:00 a.m.
offer for sale certain property described in that certain deed of trust executed by ROBERT J. HOWELL and TIFFANY R. HARRIS (fka Tiffany R. Howell) to Jennifer L. Morgan and Matthew E. Osborne, as Trustee, which deed of trust is dated the 30th day of October, 2019, and of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Trust Deed Book 580, at Page 596 ; and given to secure Citizens Bank of West Virginia , for the advancement of funds to RH Enterprises, Inc., the payment of a note therein described.
The premises subject to the above-described deed of trust are more particularly described as follows:
All that certain lot, parcel or tract of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in the Village of Kerens, in New Interest District, Randolph County, West Virginia, and more particularly bounded and described as follows:
“Beginning at a stake on the east side of the Leading Creek Pike at the small drain; thence with said pike S. 11 W. 10 P. to a stake a corner of the U.B. Church lot; thence with said Lot S. 65 E. 11 3/4 poles to a stake on the Arch Wilmoth line; thence with said line N. 11 E. 10 poles to small drain; thence down the same N. 65 W. 11 3/4 to the beginning, containing 3/4 acre, more or less.”
And being the same real estate conveyed to Robert J. Howell and Tiffany R. Howell by Jeffrey Carl Harris and Ida Ruth Moore Harris by deed dated October 5, 2011, and of record in said Clerk’s Office in Deed Book 549, at Page 21.
This conveyance is made subject to any and all reservations, restrictions, exceptions, rights-of-way and easements as set forth in prior instruments of record in the chain of title to said real estate.
Together with all buildings, structures and improvements now or hereafter situate thereon and all fixtures, materials, supplies, equipment, machinery and other property, as is now or may hereafter be an accession thereto, be a fixture thereto, or be otherwise treated or deemed as a part of the land described herein, all of which is included in the term “property” as used herein. By way of example and not by way of limitation, such fixtures shall include heating, cooling and air-conditioning units, plumbing and electrical fixtures and equipment, built-in appliances of every kind, boilers, machinery, motors, wall-to-wall carpeting, storm doors and windows, awnings and all furnishings attached to the property.
The above-described property will be sold subject to all reservations, restrictions, exceptions and conditions contained in all prior deeds conveying said real estate except those pertaining to race, color or creed, and subject to all unpaid levies and assessments including real estate taxes. TERMS OF SALE: Cash in hand on day of sale, or ten percent (10% down), or approved line of credit with closing to occur within thirty (30) days. Purchaser accepts subject real estate “AS IS”.
The undersigned Substitute Trustee reserves the right to reject any and all bids received, and to continue said sale from time to time, upon announcement thereof given verbally, on day of sale and any continuance thereof.
