NOTICE OF TRUSTEE SALE OF VALUABLE REAL ESTATE
Pursuant to the authority vested in the undersigned by deed of trust dated the 22nd day of June 2007, signed by Georgia Velas Doerr, an unmarried woman, to Richard A. Pill, Trustee, which said deed of trust is of record in the Office of the Clerk of the County Commission of Ohio County, West Virginia, in Trust Deed Book 1328, at page 682, and Golden & Amos, PLLC, Trustee having been requested so to do by the Secured Creditor, and default having been made under the terms and conditions of said deed of trust, and the provisions in said deed of trust concerning acceleration having been complied with by the Secured Creditor and present holder of the note, said Trustee will sell at public auction at 1:00 o’clock P.M. on the
24th day of JUNE 2016
at the front doors of the Courthouse in Ohio County in Wheeling, West Virginia the following described real estate:
Parcel A: The following parcels of land situate on Boggs Hill and Elm Grove Road, Triadelphia District, Ohio County, West Virginia; that is to say, the said parties of the first part do grant and convey Parcel #1, as hereinafter described, and the said William M. Campbell grants and conveys Parcel #1, as hereinafter; said parcels being more particularly bounded and described as follows:
PARCEL I: Beginning at a point on the Easterly side of a private lane at the Southwesterly corner of a parcel of land that was conveyed by William Campbell and Katherine Campbell to Thomas C. Davis, by deed dated April 19, 1924 and recorded in the office of the Clerk of the County Court of Ohio County, West Virginia in Deed Boo 195 at page 311; thence from said beginning point, and with the southerly line of the said Davis parcel, S. 63 degrees 40′ E. (at 4 and 44/100 feet passing through a fence post) 155 and 45/100 feet to a fence post in the westerly line of the Boggs Hill and Elm Grove Road; said fence post being also the southeasterly corner of a parcel of land that was conveyed by William Campbell and Katherine Campbell to Louis Castilow, by deed dated February 11, 1922 and recorded in said County Clerk’s Office in Deed Book 185 at page 479; thence with the westerly line of said Boggs Hill and Elm Grove Road, S. 48 degrees 20′ W. 84 and 45/100 feet to a fence post at the northeasterly corner of the lands that were conveyed by William Campbell and Katherine Campbell to George Kirchner and Lillian Kirchner, by deed dated February 27, 1922 and recorded in said County Clerk’s Office in Deed Book 181 at page 18; thence leaving said Boggs Hill and Elm Grove Road and with the northerly line of said Kirchner property, N. 68 degrees 42′ W. (at 97 and 14/100 feet passing through a fence post) 98 and 66/100 feet to a point in the said Easterly line of a private lane; thence with the same, N. 09 degrees 58′ E. (at 41 and 5/10 feet passing the easterly extension of the northerly of Parcel II, hereinafter described) 90 and 64/100 feet to the place of beginning, containing by survey made by Stegman & Schellhase, Inc., Civil Engineers and Surveyors, Twenty four Hundredths (24/100) of an acre, more or less.
Parcel II: Beginning at a fence post in the westerly side of a private lane at the southeasterly corner of the lot or parcel of land that was conveyed by William Campbell and Katherine Campbell, his wife, to Arthur William Weisel and wife by Deed dated December 8, 1939 and recorded in said County Clerk’s Office in Deed Book 257 at page 108; said beginning point being located N. 09 degrees 58′ E. 41 and 5/10 feet and N. 63 degrees 52′ W. 16 and 56/100 feet from the southwesterly corner of Parcel #1 described above; thence from said beginning post and with lines of said private lane, the following two (2) bearings and distances: S 09 degrees 58′ W 74 and 5/100 feet to a point; thence S. 28 degrees 28′ W. 31 feet to a point in the northerly side of the Boggs Hill and Elm Grove Road; thence along said northerly side, S. 87 degrees 58′ W. 28 and 35/100 feet to a point at the corner of the lands now or formerly owned by Butler; thence with a line of the said Butler, N. 42 degrees 00′ W. (at 101 and 16/100 feet passing through a fence post and thence at 145 and 57/100 feet passing through another fence post) 161 and 4/100 feet to a point in a line of the lands now or formerly owned by P. Kennedy; thence with said Kennedy line, N. 43 degrees 33′ E. 58 and 16/100 feet to a point at the southwesterly corner of said Weisel property; thence leaving Kennedy and with a line of said Weisel property, S. 63 degrees 52′ E. (at 16 and 43/100 feet passing through a fence post) 137 and 7/10 feet to the place of beginning, containing by survey made by Stegman & Schellhase, Inc., Civil Engineers and Surveyors, Thirty Three hundredths (33/100) of an acre, more or less.
Parcel B: The following described property situate in Triadelphia-Wheeling which is known as Parkview, Ohio County, West Virginia, that is to say: BEGINNING at a point in the northwesterly line of the Elm Grove and Boggs Hill Road and being a corner of the property formerly owned by Samuel Warden, said beginning point also the most southwesterly corner of Parcel No. 2, conveyed by William Campbell, et al, to Georgia Velas Doerr and husband by deed of record in the office of the Clerk of the County Commission of Ohio County, West Virginia, in Deed Book 402 at page 270; thence with the said northwesterly line of the Elm Grove and Boggs Hill Road, S. 67 degrees 15′ W W 79.00 feet to a point; thence leaving the said northwesterly line of the Elm Grove and Boggs Hills Road, and with the division line between the property herein conveyed and the property formerly owned by William Butler N. 49 degrees 00′ W 131.06 feet to a point in the southeasterly line of the property formerly owned by Patrick Kennedy; thence with two lines of said Kennedy property N. 46 degrees 50′ E. 47.47 feet to a point and N. 36 degrees 35′ E. 23.70 feet to a point; thence leaving said Kennedy property and with the southwesterly line of the above mentioned Parcel No. 2 conveyed to Doerr, S. 49 degrees 00″ E. 163.00 feet to the place of beginning.
The above described property is subject, however, to any adverse rights that there may be over a strip of land 40.00 feet wide, as conveyed to Patrick Kennedy, for a right of way, by deed recorded in said Clerk’s Office in Deed Book 65 at page 169.
A plat of the property hereby conveyed is recorded in said Clerk’s Office in Deed Book 474 at page 244.
The property hereby conveyed is further subject to an easement for sewer purposes which was granted to the City of Wheeling by the Circuit Court of Ohio County, West Virginia, in Civil Action No. 78-C-315, styled City of Wheeling vs. Stella Velas, et al, by Order dated September 8, 1982, which said Order is record in said Clerk’s Office in Deed Book 607 at page 763. The easement granted by the said Order is described as follows: Beginning at a point at the most westerly corner of the parcel of land that was conveyed to Stella Velas by deed recorded in said Clerk’s Office in Deed Book 545 at page 373, of which the herein described easement is a part, said beginning point also being a corner to the lands now owned by Dieckmann; thence from said beginning point and with said Dieckmann, the following two (2) bearings and distances: N. 48 degrees 13′ E. 47 and 47/100 feet to a point; thence N. 37 degrees 58′ E. 23 and 7/10 feet to a point at a corner to lands now owned by Georgia Doerr; thence leaving Dieckmann and with said oerr, S. 47 degrees 35′ E. 9 and 99/100 feet to a point; thence crossing through said Stella Velas, the following tow (2) bearings and distance; S. 20 degrees 20′ W. 35 and 41/100 feet to a point; thence S. 63 degrees 31′ W. 40 and 78/100 feet to a point in the aforesaid Dieckmann property; thence with same, N. 47 degrees 35′ W. 11 and 57/100 feet to the place of beginning, containing Twenty-six Thousandths (26/100) of an acre, more or less.
It is the intention of this notice to sell the secured property by proper description as was intended to be transferred and conveyed in the aforesaid deed of trust.

TERMS OF SALE: Cash in hand on day of sale or within 30 days of date of sale upon terms to be agreed upon between Trustee and successful bidder, time being of the essence; payment for unpaid real estate taxes to be assumed by the purchaser. The Trustee does not warrant title or fitness to this property; it is being purchased as is; this is a buyer beware sale and any buyer is advised to retain counsel before the sale. If there is any part of the process of sale which is found to be objectionable, the Trustee reserves the right to cancel the sale. No purchaser should take possession or make improvements in the premises until the Trustee deed is delivered or recorded. A third party purchaser at sale will be required to pay the purchase price plus all recording and transfer fees.
Trustee at sale is under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
The party(ies) secured by the Deed of Trust reserve the right to purchase the property at such sale. If the purchaser at sale is unable to complete the terms of purchase within 30 days, the Trustee reserves the right to transfer the property to the next highest bidder.
Any sale hereunder may be adjourned from time to time without any notice other than oral proclamation at the time and place appointed for this sale or by posting of a notice of same. Should the Trustee not appear at the time appointed for the sale and there is no notice posted of a continuance please contact the office of the Trustee to make further inquiry. Any sale may be conducted or adjourned by the designated agent or attorney of the Trustee. The undersigned is fully vested with the authority to sell said property as Trustee by instrument of record.
