TRUSTEE’S SALE OF VALUABLE REAL ESTATE

The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated May 20, 2020, and duly recorded in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Deed of Trust Book 587, at Page 563, Amanda Poling did convey unto Mary E. Page, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Randolph County Courthouse, in Elkins, West Virginia, on

September 16, 2022, at 11:27 AM

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Middle Fork District, Randolph County, West Virginia, and more particularly described as follows:

That certain tract or parcel of real estate containing one (1) acres, more or less, situate in Middle Fork District, on the left fork of the right fork of the Buckhannon River, between the communities of Helvetia and Czar, Randolph County, West Virginia, more particularly bounded and described as follows:

Beginning at an iron pipe and being the western corner of that certain tract of property described and shown on the plat recorded in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Deed Book 406 at Page 457, as one (1) acre, and described as “beginning”, thence N 47 00′ E, 230.00 feet to an iron rod; thence S 24 30′ E, 190.00 feet to an iron rod; thence S 47 00′ W, 230.00 feet to an iron rod; thence N 24 30′ W, 190.00 feet to the beginning, containing one (1) acre, more or less, as shown on a copy of the plat recorded in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Deed book 406, at Page 457.

There is further conveyed an easement, over the bridge across the left fork of the right fork of the Buckhannon River and over the existing road or lane which is situate near the call N 24 30′ W, 190 feet, for ingress and egress to and from the instant real estate hereby conveyed through and across the residue of the Grantor’s property to Secondary Route 46.

It is understood and agreed , that this conveyance is made subject to all out conveyances, reservations, restrictions, rights-of-way, covenants, leases and licenses contained in any documents constituting the chain of title to said real estate, which documents may be found of record in the aforesaid Clerk’s Office, including, but not limited to those restrictions, reservations, exceptions, easements, limitations, covenants, etc., as more fully set out in that certain Deed of Conveyance dated the 19th day of September, 1977, from James E. Smith and Vada J. Smith, husband and wife, to John D. Spittle and Rebecca L. Spittle, husband and wife, (all predecessors in title), recorded in the aforesaid Clerk’s Office in Deed Book 311, at Page 598.

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 60 Smiths Bridge Road, Helvetia, WV 26224.

AND BEING the same real estate which was conveyed to Amanda Poling by Deed dated May 20, 2020, from Lark Higginbotham, and recorded in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Deed Book 606. at Page 520.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
