By virtue of that certain Deed of Trust made by Thomas L. Lantz, Sr. and Patricia A. Lantz, his wife, Grantors to William G. Petroplus, Trustee dated the 30th day of June, 2009, and of record in the Office of the Clerk of the County Commission of Ohio County, West Virginia, in Deed of Trust Book 1377, at Page 735; and that certain Appointment of Successor Trustee dated the 22nd day of July, 2022, and of record in the Office of the aforesaid Clerk in Deed of Trust Book 1661, at Page 193, the undersigned will sell at public auction and subject to the terms and conditions set forth in this Trustee’s Notice of Sale and in the said Deed of Trust on the 21st day of September, 2022, at 10:00 a.m. at the northwest front door of the Ohio County Courthouse, 1500 Chapline Street, Wheeling, West Virginia, 26003, the following described property situate at 104 Noble Street, Triadelphia, Ohio County, West Virginia, 26059:

All of the following described southwesterly part of the parcel of land that was conveyed to said Lavenia B. Simms and S. Nesbitt, Jr. by R. L. White and Lillie May White, his wife, by deed dated May 18, 1918, situated on the waters of Little Wheeling Creek, near the National Road, in Ohio County, West Virginia, bounded as follows, to-wit: Beginning at a point in the southerly line of said parcel of land at a point forty-six and twelve hundredths (46.12) feet from a stake in the southwesterly corner of said parcel of land, thence S. 76 degrees 44′ E. 41.92 feet, binding thereof on said southerly line, thence N. 30 degrees 39′ E. 72.57 feet, thence N. 59 degrees 21′ W. 40 feet to a point, thence S. 30 degrees 39′ W. 85.09 feet to the place of beginning, the last named line being the southeasterly line of that part of said parcel of land conveyed to said second party by said first parties by deed of even date herewith. Said parcel of ground, hereby conveyed, is marked as lot “18” on the “Plat of Simms & Nesbitt’s Addition to Triadelphia, Ohio County, W.Va.”

Being the same property conveyed to Thomas L. Lantz, Sr. and Patricia A. Lantz, husband and wife, to Thomas J. Nassif, Jr. and Bonnie C. Nassif, husband and wife, dated the 28th day of June, 2009, and of record in the Office of the Clerk of the County Commission of Ohio County, West Virginia, in Deed Book 794, at Page 576.

TERMS OF SALE: Sale of the property will be made subject to the lien for any and all real estate taxes, whether or not currently due, owing, delinquent, or payable, whether paid or otherwise not currently payable; including especially, but not limited to, the lien of Community Bank, formerly known as Progressive Bank, N.A., dated the 30th day of June, 2009, and of record in the Office of the aforesaid Clerk in Deed of Trust Book 1377, at Page 735; and otherwise referred to above; and further sale of the subject interest in the property is subject to any and all other liens, encumbrances, or adverse claims of interest which may be superior to the lien of the said Deed of Trust being foreclosed upon or the title of Trustee hereunder. The property will be conveyed in an “AS IS”, without warranty or representation, express or implied, as to title, physical condition, environmentally condition, or any other adverse condition which might affect merchantability, marketability, fitness, or use of the property. The property will be conveyed subject to the Internal Revenue Service right of redemption, the Purchaser shall be responsible for the payment of the excise tax on the privilege of transferring real property; the Trustee reserves the right to continue the sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee; the Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property or any duty to remove any personal property and/or belongings remaining at the property after the subject sale. CASH IN HAND or CERTIFIED FUNDS (Certified check) in full in the amount of the successful bid or bids on the day of the sale is required for any bidder to purchase the subject property.
