NOTICE OF SUBSTITUTE TRUSTEE’S SALE

Notice is hereby given that the undersigned, Harry A. Smith, III, as Substitute Trustee, will offer for sale at pu+blic auction, to the highest responsible bidder, certain real estate, described below, situate in Leadsville District, Randolph County, West Virginia. Said real estate will be offered for sale at the front door of the Randolph County Courthouse, Elkins, West Virginia, on the 12th day of October, 2022, at 10:00 a.m.
The described real estate was conveyed by the following deed of trust securing Mountain Valley Bank, N.A.: a deed of trust executed by Darren R. Blankenship and Crystal D. Blankenship, dated September 30, 2009, of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Trust Deed Book 462 at page 651.
The real estate herein offered for sale is, specifically, that certain lot, parcel or tract of real estate, together with the improvements thereon and the appurtenances thereunto belonging, situate in Leadsville District, Randolph County, West Virginia, being more particularly bounded and described as follows:
That certain tract or parcel or real estate situate in Leadsville District of Randolph County, on the waters of Beaver Creek in said Leadsville District of said County, and more particularly bounded and described as follows:
“BEGINNING at a spruce pine on the bank of said creek and running N. 15 W. 9 1/2 poles to a poplar; thence S. 75 W. 26 poles to a red oak; thence N. 5 E. 44 1/2 poles to a rock; thence N. 86 E. 60 poles to a rock; thence N. 5 E. 44 1/2 poles to a rock; thence N. 86 E. 60 poles to a rock; thence S. 4 ½ E. 32 poles to a rock on the said creek; thence down the meanders of said creek to the place of beginning.
ALSO, a contiguous tract beginning at the same beginning corner, as above described and running thence N. 15 W. 9 1/2 poles to a poplar; thence S. 75 W. 26 poles to a red oak; thence N. 71 W. 24 1/2 poles to a rock oak; thence N. 82 W. 15 poles to a poplar; thence S. 6 E. 26 poles to a large pine on a creek; thence with the meanders of the creek to the place of beginning, containing together 21 1/4 acres, more or less, in both tracts, excepting an outconveyance made by predecessors in title to Greenberry C. Freeman, of record in Deed Book 100, at Page 190, in the aforesaid Clerk’s Office; and the conveyance to Macil Scott by Greenberry C. Freeman, in Deed Book 159, at Page 210, in said Clerk’s Office, to which reference is herenow made.”
Being the same real estate conveyed to Darren R. Blankenship and Crystal D. Blankenship, by Wendell B. Scott and Hattie M. Scott, by deed dated August 1, 2007, of record in the aforesaid Clerk’s Office in Deed Book 518 at page 342.
Said real estate is assessed in the names of Darren R. Blankenship and Crystal D. Blankenship in Leadsville District, Randolph County, described by the Randolph County Assessor as “20.5 Ac. Beaver Ck” (Tract 109, Parcel 7).
Said sale will be “as is” and will be without covenant or warranty and will be subject to all unpaid property taxes and to all existing reservations, restrictions, exceptions, conditions, easements, rights-of-way or other servitudes, if any, made, retained or created in prior deeds of record in the chain of title to the property herein described. The purchaser shall be responsible for the payment of the transfer taxes imposed by Article 2 of Chapter 11 of the West Virginia Code.
The undersigned reserves the right to reject any and all bids and to continue the sale of the real estate from time to time by announcement made at the time of the sale or any continuance thereof.
The undersigned shall be under no duty to cause any existing tenant or person occupying the property to vacate the property. Any personal property remaining at the property after the foreclosure sale will be deemed to constitute abandoned property, to be disposed of by the purchaser; before such personal property may be deemed abandoned, however, the purchaser must comply with the provisions of section 38-1-17, West Virginia Code, and provide proper and legal notice to the previous owners that such personal property remaining on the real property will be deemed abandoned if not removed before the conclusion of the notice period set forth in said section 38-1-17.
The undersigned was appointed as Substitute Trustee by Appointment of Substitute Trustee dated October 20, 2021, now of record in the aforesaid Clerk’s Office in Trust Deed Book 610 at page 421.
TERMS OF SALE: Cash in hand on date of sale.
