By virtue of that certain Deed of Trust made by Mark C. Busack, to John E. Gompers, Trustee, dated the 16th day of January, 2013, and of record in the office of the Clerk of the County Commission of Ohio County, West Virginia, in Deed of Trust Book No. 1453, at page 48, the undersigned will sell at public auction, and subject to the terms and conditions set forth in this Trustee’s Notice of Sale and in the said Deed of Trust, on the 12th day of July, 2016, at 10:00 o’clock A.M., at the northwest front door of the Court House of Ohio County, Wheeling, West Virginia, the following described property (“Property”) situate at 150 Scenery Rd, Wheeling, Ohio County, West Virginia 26003, and being more particularly described as follows:
Situated in the County of Ohio and State of West Virginia:

The following parcel of land situate on the southerly side of Ridge Way, comprising a part of Lots 27 and 28 as shown on the Revised Map of Atkinson Farms, said map being recorded in the Office of the Clerk of the County Commission of Ohio County, West Virginia in Plat Book 2, at page 83, Triadelphia District, Ohio County, West Virginia and also known as Lot 7 Scenery Hill and being more particularly bounded and described as follows:

Beginning at a point in the southerly line of Ridge Way, said point being located N. 82* 42′ W. 33 and 76/100 feet from a point at the northeasterly corner of Lot 28; thence from said beginning point and crossing through Lot 28, S. 02* 14′ 59″ W. (at 112 and 49/100 feet passing the division line between Lots 27 and 28) 215 and 99/100 feet to an iron pin at a common corner to a 563/1000 acre parcel of land and a 428/1000 acre parcel of land, now or formerly owned by the party of the first part hereto; thence with the easterly line of said 428/1000 acre parcel N. 46* 43′ 24″ W. 120 and 65/100 feet to an iron pin at a common corner to said 428/1000 acre parcel and a 645/1000 acre parcel of land now or formerly owned by the party of the first part hereto, said iron pin also being in the division line between Lots 27 and 28; thence with the easterly line of said 645/1000 acre parcel N. 10* 31′ 12″ W. 151 and 54/100 feet to a point in said southerly line of Ridge Way; thence with same S. 82* 42′ E. 125 feet to the place of beginning, containing four hundred thirty-two one thousandths (432/1000) acres, more or less, as compiled from calculations by Stegman & Schellhase, Inc., Civil Engineers and Surveyors on May 10, 2006.

Said parcel being subject to a twenty (20) feet wide building line setback along Ridge Way and a five feet wide utility easement within said setback, the northerly line of said easement being the northerly line of said 432/1000 acre parcel.

There is also granted to the party of the second part hereto, the right to use the sewer facilities if and when they become available.

Said parcel being subject to any and all conditions, exceptions, reservations, stipulations, rights of way etc., as may be contained in former deeds.

Being the same property which was heretofore conveyed to Mark C. Busack, by Alan D. Baker, by a Deed dated the 6th day of July, 2006, and recorded in the aforesaid County Clerk’s office in Deed Book No. 770, at page 395.

TERMS OF SALE: Sale of the Property will be made subject to the lien for any and all real estate taxes, whether or not currently due, owing, delinquent or payable, whether paid or are otherwise not currently payable; including especially but not limited to the Lien of Main Street Bank secured by Deed of Trust dated March 12, 2012, and recorded in the Ohio County Clerk’s Office in Deed of Trust Book 1432, at page 229; and further, sale of the subject interest in the Property is subject to any and all other liens, encumbrances, or adverse claims of interest which may be superior to the lien of the Deed of Trust being foreclosed upon or the title of Trustee hereunder. The Property will be conveyed “As Is”, without warranty or representation, express or implied, as to title, physical condition, environmental condition or any other adverse condition which might affect merchantability, marketability, fitness or use of the Property. CASH IN HAND or CERTIFIED FUNDS (Certified Check) in full in the amount of the successful bid or bids on the day of the sale is required for any bidder to purchase the subject Property.
