NOTICE OF SALE

Pursuant to the authority vested in me by Order of the Circuit Court of Randolph County, West Virginia, following a hearing held on November 4, 2022, in Civil Action No. 22-C-54, entitled In Re: The Estate of Doris Frances Jack, Plaintiff v. Susan Reece and Michael Jack, as Special Commissioner of said Court shall, on the 13th day of January, 2023, commencing at 10:00 a.m., proceed to sell at the front door of the courthouse of Randolph County, West Virginia, at public auction, to the highest responsible bidder, the following described tract or parcel of real estate situate at 115 Westview Drive, Elkins, WV 26241, lying and being in the Lough Addition in the City of Elkins, Randolph County, West Virginia, being more particularly bounded and described as follows:

Lot No. 15 of said Addition bounded as follows: On the north for 100 feet by West View Street; on the east for 212 feet by Lot No. 14 and an alley for 9.7 feet; on the south for 116 feet by a 15 foot alley; and on the west for 156.4 feet by Lot No. 16; Tax Map 5, Parcel No. 0132.

AND BEING the same real estate conveyed unto Lowell W. Jack and Doris F. Jack, husband and wife, as joint tenants with rights of survivorship, by Sterl H. Dean and Shirley A. Dean, husband and wife, by deed dated May 31, 2000, and of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Deed Book 472, at page 566. The said Lowell W. Jack is purported to have died in Prince William County, Virginia, in the month of January 2001, and by virtue of the survivorship language set forth in the aforesaid deed, the subject real estate vested in the survivor thereof, Doris F. Jack, in fee simple absolute. The said Doris F. Jack died intestate on April 26, 2021, and by virtue of the laws of descent and distribution in effect in the State of West Virginia, at the time of her death, the subject real estate was inherited by her children, Susan Reece and Michael W. Jack.

The sale shall be made without warranty, subject to all reservations, exceptions, covenants, restrictions, limitations, conditions, rights of way or easements, and other servitudes, if any, made, retained or otherwise created by deeds or other instruments constituting the record chain of title to the real estate aforesaid, subject always to all accrued and unpaid ad valorem taxes. This sale is being conducted without certification of title and will be made subject to any liens, judgments or other encumbrances of record. Anyone who is interested in purchasing the property should contact an independent attorney for a title examination, if they so desire.

This sale shall further be made subject to all necessary rights of way for ingress, egress and regress, water/sewer, and utility service to the real estate.

Terms of sale: Cash in hand on date of sale or letter of certified funds available to close within thirty (30) days.
