TO THE ABOVE NAMED DEFENDANTS:
The object of this action is to CLAIM BY PARTITION AND QUIET TITLE to certain real property located in Grant District, Wetzel County, West Virginia, described as follows:
FIRST PARCEL: Beginning at a Hy, thence S 62 W 66 poles to a stone, thence N 45 W 34 poles to a C. O.; thence N 80 W 40 poles to a Hy; thence N 55 W 32 poles to a C. 0. in the line of land now or formerly owned by W. Norris; thence N E 40 poles to a C. O.; thence N 75 E 78 poles to a Buck; thence S 38 E 72 poles to the place of beginning, containing fifty (50) acres, more or less.
SECOND PARCEL: Beginning at a C.O. on the ridge comer to said first parcel; thence S. 52 E. 29 poles to a Hy; thence S. 78 E. 38 poles to a C.O.; thence S 47-1/2 E. 30 poles to a stone; thence N. 63 E. 66 poles to a post comer to land now or formerly owned by J. W. Norris; thence S. 37 E. 33 poles to a post; thence S.43 W. 39 poles to a post; thence S. 1 W. 96 poles to a post and pointers comer to land now or formerly owned by B.W. Peterson; thence N. 79 W. 65-1/4 poles to a Pin Oak; thence N. 29-1/4 W. 60 poles to a stone on pointers on the ridge; thence S. 83 W. 14 poles to a Pin Oak, thence N. 72 W. 29 poles to a post; thence N. 8 W. 63-3/4 poles to a C.O.; thence N. 20 E. 33 poles to the place of beginning, containing one hundred and three- tenths (100.3) acres, more or less.
THIRD PARCEL: Beginning at a dead chestnut on a ridge; thence N. 14-1/2 W. 11-24/100 poles to a stone, and pointers; thence with an old fence N. 75 E 81 poles to a stone; thence S 17 E. 11-56/100 poles to an old beech stump (now a stone); thence S. 75 W. 81 poles to the place of beginning, containing five (5) acres and one hundred twenty (120) poles, more or less.
Any person named above or any person who has an interest in this proceeding must appear and defend within thirty (30) days of the first publication of this ORDER; otherwise, a judgment by default will be rendered against any such person at any time thereafter.
