The object of the Civil Action, as is more particularly described in the Complaint filed herein, is to seek
appointment of substitute trustees charged with management of the certain burial ground identified as the Morgan Cemetery and approval of a proposed agreement between said trustees and Harrison County Coal Resources, Inc. (“HCCR”) waiving any and all
liability associated with the removal of the Pittsburgh coal underlying the Cemetery.
The subject property comprising the Morgan Cemetery consists of all the land identified as Surface Tax Map 29A, Parcel 2, in Grant District, Wetzel
County, West Virginia, containing 0.88 acres, more or less, as per the survey conducted by George D. Six, dated January 28, 2022, which was historically deed and conveyed in the Deed from I.D. Morgan and Minnie Morgan, his wife, to B.F. Copenhaver, W.B. Taylor, L.S. Walters, W.B. Snodgrass, and W.R. Snodgrass, Trustees of the Morgan Cemetery, dated July 8, 1905, recorded July 11, 1905, in Deed Book 92, page 509, conveying a tract of land containing 121 1/2 square poles, more or less, “to be used for burial purposes only.”
It appearing by Affidavit filed in this action that
Petitioners, by its counsel, have contemporaneously herewith attempted to obtain service upon the locatable Respondents via certified mail, return receipt requested and delivery restricted to the addresses, and have used due diligence, pursuant to Rule 4(e)(1)(C) of the West Virginia Rules of Civil Procedure, to ascertain the
addresses or whereabouts of the Respondents, it is therefore ORDERED that the Respondents named herein appear and serve upon W. Taylor Frankovitch, Bowles Rice LLP, counsel for Plaintiff, whose address is 125 Granville Square, Suite 400, Morgantown, West
Virginia 26501, a response or other defense to the
Petition heretofore filed in this action on or before February 15, 2023, or within 30 days after the date of first publication of this notice, whichever is later.
Otherwise, the Court may render a judgment of default against said Respondents at any time thereafter,
thereby granting the relief requested by Petitioners in this Action.
A copy of said Petition can be obtained from the
Office of the Clerk of the Wetzel County Circuit Court, Wetzel County Courthouse, 200 Main Street, New
Martinsville, West Virginia 26155.
By Order of the Circuit Court, this matter has been set down for a hearing on March 13, 2023 at the hour 10:00 am at the Wetzel County Courthouse, 200 Main Street, New Martinsville, West Virginia 26155, during which the Court shall consider the allegations set forth in the Petition filed in the above-styled Civil Action and the relief requested therein. All persons who may have an interest in the subject matter of the above-styled Civil Action are invited to appear on that date and protect their interests.
