Thalman, appointed by the Appointment of Substitute Trustee document dated December 22, 2022, and of record in the Office of the Clerk of the Commission of Brooke County, West Virginia, in Deed of Trust Book 628, at Page 105, will sell at public auction to the highest bidder on:

at 10:00 a.m
At 140 Buckey Hill Road aka RD 1 Box 242 B, Wellsburg, WV 26070, that certain property conveyed by Loman C. Edgell, Jr., a single man, to Arthur J. Recht, Trustee, by Deed of Trust dated February 19, 2004, and recorded in the office of the said Clerk of the County Commission of Brooke County, West Virginia, in Deed of Trust Book 419, at Page 153, and being described as follows:
All that certain tract or parcel of land situate on a public road leading from the Wellsburg and Washington Pike, in Cross Creek District, Brooke County, West Virginia, and more particularly described as follows: Beginning at a point in said public road, corner to lands of Charles Snowden, thence leaving said public road and with the line of land of Charles Snowden S 39 degrees 00′ E 217 8 feet to a stake in the line of land of Charles Snowden and corner to other lands of Cree, thence with other lands of Cree S 51 degrees 00′ W 100 0 feet to a stake, thence again with other lands of Cree N 39 degrees 00′ W 217 8 feet to a point in said public road N 51 degrees 00′ E 100 0 feet to a point, the place of beginning, containing 0.5 of an acre, more or less.
Being the same property conveyed to Loman C. Edgell, Jr. by Deed of Carolyn I. Beagle, widow, dated the 19th day of February, 2004, and of record in the Office of the Clerk of the County Commission of Brooke County, West Virginia, in Deed Book No. 306 at Page 626.
This conveyance is made subject to all restrictions, reservations, and exceptions as set forth in prior Deeds of record hereto and plat thereof.

The terms of the sale will be as follows: Cash in hand on the day of sale. Sale of said property will be made subject to: (1) All prior exceptions, reservations, rights of way, easements, conditions, covenants, restrictions, leases and other servitudes of record, if any, pertaining to said real estate; (2) any and all unpaid taxes assessed against said property; (3) the subject property will be sold in “as is” condition; (4) the Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property; and (5) the Substitute Trustee will deliver a Substitute Trustee’s Deed to the purchaser without any covenant or warranty (expressed or implied) in the form prescribed by West Virginia Code Chapter 38-1-6. The Substitute Trustee makes no representations and warranties about the title of the real estate to be conveyed.
Any sale hereunder may be adjourned from time to time without notice other than oral proclamation at the time and place appointed for the sale. The Substitute Trustee reserves the right to reject any or all bids. Additional terms and conditions shall be announced at the sale.
