TRUSTEE’S SALE OF VALUABLE REAL ESTATE
The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated September 22, 2006, and duly recorded in the Office of the Clerk of the County Commission of Hancock County, West Virginia, in Document No. 200600005976, in Book No. 558, at Page 520, George James Keeper and Melissa Sue Keeper did convey unto Pamela M Smoljanovich, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by THE BANK OF NEW YORK MELLON FKA THE BANK OF NEW YORK, AS TRUSTEE FOR THE CERTIFICATEHOLDERS OF THE CWABS Inc., ASSET-BACKED CERTIFICATES, SERIES 2006-22 to foreclose thereunder, will offer for sale at public auction at the front door of the Hancock County Courthouse in New Cumberland, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 03 – Clay District, Hancock County, West Virginia, and more particularly described as follows:
All that certain tract or parcel of land known as part of L.W. Baker Farm, situate in Clay District, Hancock County and State of West Virginia, more particularly described as follows: BEGINNING at a point on the southwesterly corner of the parcel of land owned by J.W. Harless; running thence South 25 degrees 25 minutes East 24.25 feet to a point in the center line of the County Road; running thence by the same Road line South 73 degrees 50 feet West 214.0 feet to a point which point is the true beginning of the parcel of land hereby described and conveyed; thence North 8 degrees 30 minutes West 202.10 feet to a point; thence South 81 degrees 30 minutes West 326.30 feet to a point; thence South 12 degrees 21 minutes East 350.45 feet to a point in the center line of said County Road; thence by the same line North 73 degrees 50 minutes East 503.50 feet to the place of the true beginning, containing 3.14 acres more or less. EXCEPTING AND RESERVING THE FOLLOWING:
All that certain parcel of land situate in Clay District, Hancock County, West Virginia along Ballantyne Road and being more particularly described as follows:
Beginning at a fence post found at the south-west corner of a .70 acre tract of Hillis as on record in the Office of the Clerk of the County Court, Hancock County, West Virginia in Deed Book 234 at page 518; thence with the division line of Barton and Hillis and a fence line north 81 degrees 20 minutes 25 second east 326.25 feet to a 1/2 inch pin found at the north-west corner of a 1.13 acre tract of Hillis as on record in the Office of the Clerk of the County Court, Hancock County, West Virginia in Deed Book 171 at page 302; thence with the division line of Barton and Hilis and an old fence line south 08 degrees 36 minutes 38 second east 203.79 fee to the center of Ballantyne Road and at the south east corner of Barton; thence with said center line south 73 degrees 50 minutes west 314.55 feet to a point; thence leaving said road north 11 degrees 58 minutes 16 seconds west 245.3 feet to the place of beginning containing 1.647 acres as shown on a plat map attached hereto and made a part of this description.
At the time of the execution of the Deed of Trust, this property was reported to have an address of:
889 Ballantyne Rd,
New Cumberland, WV 26047-4197.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $5000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
