PUBLIC NOTICE
Please take notice that on the 16th of February 2023, at 9:30 a.m. in City Council Chambers, Room 103, City-County Building, Wheeling, WV the Board of Zoning Appeals will meet to consider the application of Heartland Restaurant Group LLC – 855 National Road – Request No. 1: Variance relief from the minimum parking requirement provided in Article 1355.02(d) and set forth in Table 9-A so that sixteen (16) parking spaces can be provided as proposed rather than the minimum standard of 21 parking spaces calculated for the proposed “eating and drinking establishment.” Request No. 2: Variance relief from Article 1355.03(c) as it pertains to permitting the proposed parallel parking spaces to be located within the five-foot setback requirement from the side property line. Request No. 3: Variance relief from Article 1355.03(a) as it pertains to permitting one (1) parking space to be located within the 10-foot required front yard. Request No. 4: Variance relief from Article 1355.04(e) as it pertains to permitting one (1) parking space to be in such proximity to the National Road public right-of-way that exiting said parking space may require partial use of said public right-of-way. Request No. 5: Variance relief from Article 1355.05(a) as it pertains to providing at least two (2) requisite major deciduous trees within the interior of the parking area. Purpose of the request: New Development. The property is described as follows: Parcel 10-W39-37 and 10-W39-381 as recorded in the Ohio County Clerk’s Office. More commonly known as 855 National Rd.
