NOTICE OF FILING
AND HEARING
On February 22, 2023, BMG Transport, LLC (BMG) filed an application for transfer of Certificate No. 7513 to IC Cab, LLC (Application). The authority under P.S.C. M.C. Certificate No. 7513 authorizes the holder –
to operate as a common carrier by motor vehicle in specialized multi- passenger van service in the transportation of railroad employees for railroad-related work purposes between points and places in Ohio, Marshall and Wetzel Counties, on the one hand, and points and places in West Virginia, on the other hand.
The Commission previously approved the transfer of P.S.C. Certificate Nos. 423 and 7597 from BMG Transport, LLC to IC Cab, LLC in Case Nos. 22-0809-MC- TC and 22-0810-MC-TC.
By Order issued March 6, 2023, the Commission confirmed the completeness of the Application and scheduled this matter for a hearing on April 20, 2023.
Anyone desiring to protest or intervene should file a written protest or notice of intervention should file in writing as soon as possible, but no later than ten (10) days following the date of publication of this Notice. Requests to intervene must comply with the Commission’s rules on intervention set forth in the Commission’s Rules of Practice and Procedure. All protests may be filed online through the Commission website using the “Submit a Comment” link or may be mailed to the Executive Secretary, Public Service Commission of West Virginia, P.O. Box 812, 201 Brooks St., Charleston, West Virginia 25323, or hand-delivered to the Public Service Commission.
This matter is set for a hearing at 9:30 a.m. on Thursday, April 20, 2023, in the Howard M. Cunningham Hearing Room at the Commission headquarters located at 201 Brooks Street, Charleston, West Virginia. If no protests are received, the Commission may waive formal hearing and render its decision on the Application based on the evidence submitted with the Application and the Commission’s review thereof. Interested persons intending to attend the hearing should monitor the Commission web docket.
