Notice is hereby given that the undersigned Substitute Trustee, appointed by document dated March 16, 2023, and of record in the Office of the Clerk of the Marshall County Commission in Deed of Trust Book 1111, at page 163, will sell at public auction to the highest bidder on:

at the front door of the Marshall County Courthouse, 600 Seventh Street, Moundsville, West Virginia, that certain property conveyed by Tracie L. Nelson to Ronal W. Rush, Original Trustee, by Deed of Trust dated August 19, 2015, and recorded in the office of the said Clerk of the County Commission of Marshall County, West Virginia, in Deed of Trust Book 970, at page 617, and being described as follows:
The following described lot or parcel of real estate situate in Clay District, Marshall County, West Virginia, and being more particularly bounded and described as follows, to wit:
Beginning at a point in the center of Kull’s Lane Road at the southeast corner of a 10.0 acre tract as reserved in a deed from James C. Rine and Ethel Faye Howe to Brenda Faye Rine as recorded in Deed Book 639, Page 448 of the Marshall County records, thence with easterly line of said tract N 16 degrees 21′ 26″ E 811.52 feet to a point at the northwest corner of a 103.74 acre tract (less exceptions) of Rine (Deed Book 639, Page 448), passing through iron pins at 30.0 feet, 230.0 feet, 390.0 feet, 590.0 feet, and at 786.52 feet, thence with the northerly lines of said 103.74 acre tract S 58 degrees 50′ E 311.75 feet to a point, thence N 89 degrees 51′ 47″ E 334.64 feet to a marked stone, thence running through said tract S 17 degrees 48′ 59″ W 227.90 feet to an iron pin, thence S 13 degrees 39′ 35″ W 201.54 feet to an iron pin, thence
S 04 degrees 53′ 44″ W 237.62 feet to an iron pin, thence S 31 degrees 00′ 50″ W 222.26 feet to a point in the center of Kull’s Lane Road, passing through an iron pin at 204.02 feet, thence with the center of said road the following live courses: N 62 degrees 14′ 32″ W 174.79 feet to a point, thence N 66 degrees 34′ 50″ W 87.60 feet to a point, thence N 72 degrees 01′ 33″ W 88.39 feet to a point, thence N 76 degrees 58′ 06″ W 152.24 feet to a point, thence N 68 degrees 13′ 35″ W 118.84 feet to the place of beginning, containing 11.521 acres, more or less, according to a survey done by Chadan Engineering, Inc., in September, 2005
The above-described tract is subject to the right-of-way for said Kull’s Lane Road.
Being the same property conveyed to Tracie L. Nelson by Brenda Faye Rine, single, by Deed January 10, 2006, and recorded in Marshall County Deed Book 649, at page 451.

The terms of the sale will be as follows: Cash in hand on the day of sale. Sale of said property will be made subject to: (1) All prior exceptions, reservations, rights of way, easements, conditions, covenants, restrictions, leases and other servitudes of record if any pertaining to said real estate; (2) any and all unpaid taxes assessed against said property; (3) the subject property will be sold in “as is” condition; (4) the Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property; (5) the Substitute Trustee will deliver a Substitute Trustee’s Deed to the purchaser without any covenant or warranty (expressed or implied) in the form prescribed by West Virginia Code Chapter 38-1-6. The Substitute Trustee makes no representations and warranties about the title of the real estate to be conveyed.
Any sale hereunder may be adjourned from time to time without notice other than oral proclamation at the time and place appointed for the sale. The Substitute Trustee reserves the right to reject any or all bids. Additional terms and conditions shall be announced at the sale.
Any sale hereunder in which the property is encumbered by Federal Tax Liens will be subject to the 120-day redemption period pursuant to 26 U.S.C.A. Section 7424(d).
