PUBLICATION
The object of the above entitled action is to determine that the Last Will and Testament Jeraldine Willabee Dailey, deceased, be construed in the manner more particularly set forth in the Petition to Construe the Last Will and Testament of Jeraldine Willabee Dailey in this proceeding. And it appearing by affidavit filed in this action that counsel for Petitioner has used due diligence to ascertain the identities of unknown and unlocatable potential heirs of Jeraldine Willabee Dailey through the use of the internet and proprietary software but was unable to discover additional information regarding any potential additional unknown heirs. Therefore, it is ordered that:
Unknown heirs of Jeraldine Willabee Dailey do appear and serve upon Ryan W. Weld and Jordan A. Sengewalt, of Spilman Thomas and Battle, PLLC, Petitioner’s attorneys, whose address is 1233 Main Street, Suite 4000, Wheeling, West Virginia 26003, an answer or other defense to the Petition to Construe the Last Will and Testament of Jeraldine Willabee Dailey filed in this action on or before thirty (30) days from the date of first publication. Otherwise, judgment by default will be taken against said Respondents at any time thereafter.
A copy of said Petition can be obtained from Brenda L. Miller, Clerk of the Circuit Court of Ohio County, West Virginia, at her office located on the 4th Floor of the Ohio County Courthouse, 1500 Chapline Street, Wheeling, West Virginia.
