The purpose of this Notice is to identify two (2) separate but related procedural notification requirements for an activity to be undertaken by the City of Wheeling, West Virginia, acting in its capacity as the administering jurisdiction for the WV Northern Panhandle HOME Consortium,

Request for
Release of Funds
On or about March 31, 2015 the City of Wheeling will submit a request to the U.S. Department of Housing and Urban Development for the release of Federal funds under the HOME Investment Partnership Program of the National Affordable Housing Act of 1990, as amended, to undertake the following project:

Assessed Project
Fiscal Year 2013 Community Housing Development Organization (CHDO) Set Aside

Funds will be provided to CHANGE, Inc. for the renovation of the structure located at 3144 Orchard Street, Weirton, West Virginia for the purpose of providing an affordable housing unit to be sold to a low-and moderate income household.

Finding of No
Significant Impact
The City of Wheeling has determined that the above listed project will not constitute an action significantly affecting the quality of the human environment and, accordingly, the City of Wheeling has decided not to prepare an Environment Impact Statement under the National Environmental Policy Act (NEPA) of 1969 (PL 91-190).

The reason for the decision not to prepare such Statement are as follows: No impact threshold will be exceeded as a result of pursuing the cited activity.

The Environmental Review Record respecting the proposed project has been prepared by the City of Wheeling which documents the environmental review of this project and more fully sets forth the reason why such Statement is not required. The Environmental Review Record is on file at the following office: The City of Wheeling, Economic and Community Development Department, Room 305, City-County Building, 1500 Chapline Street, Wheeling, West Virginia 26003 and is available for public examination between the hours of 8:30 a.m. and 5:00 p.m., Monday through Friday, excluding legal holidays. No further environmental review of the project is proposed to be conducted prior to the request for release of Federal funds.

Public Comments
Any individual, group, or agency disagreeing with this determination or wishing to comment on the project may submit written comments to the City of Wheeling, Department of Economic and Community Development at 1500 Chapline Street, Wheeling, West Virginia 26003 All comments on or before March 31, 2015 will be considered by the City of Wheeling prior to submitting the request for the release of funds. Comments should specify which part of this Notice they are addressing. The City of Wheeling will not request the release of funds or take any administrative action on the proposed project prior to the date specified in the preceding sentence.

Release of Funds
The City of Wheeling hereby certifies to HUD that the City and Robert Herron, in his official capacity as City Manager, consents to accept the jurisdiction of the Federal Courts if any action is brought to enforce responsibilities in relation to the environmental review process, decision making and action, and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the City of Wheeling to use program funds.

Objections to
Release of Funds
HUD will consider objections to its release of funds and the City of Wheeling’s certification received by April 17, 2015 or a period of fifteen days from its receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer or other officer of the City of Wheeling approved by HUD; (b) the City of Wheeling has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other participants in a project has committed funds, incurred costs, or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal Agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to the U.S. Department of Housing and Urban Development, Director of Community Planning & Development, Moorhead Federal Building, 10th Floor, 1000 Liberty Avenue, Pittsburgh, Pennsylvania 15222-2515. Potential objectors should contact HUD to verify the actual last day of the objection period.

Objections to the release of funds on bases other than those stated above will not be considered by HUD. No objection received after April 17, 2015 will be considered by HUD, unless, because of an unforeseen delay, the request for release of funds was received after the date mentioned at the beginning of this Notice. Because this is possible, and would cause a change in the objection period, objectors should contact HUD to verify the date of the last day of the objection period.
