Release of Funds
HUD will consider objections to its release of funds and the City of Wheeling’s certification received by April 17, 2015 or a period of fifteen days from its receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer or other officer of the City of Wheeling approved by HUD; (b) the City of Wheeling has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other participants in a project has committed funds, incurred costs, or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal Agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections to the release of funds on bases other than those stated above will not be considered by HUD. No objection received after April 17, 2015 will be considered by HUD, unless, because of an unforeseen delay, the request for release of funds was received after the date mentioned at the beginning of this Notice. Because this is possible, and would cause a change in the objection period, objectors should contact HUD to verify the date of the last day of the objection period.
