TRUSTEE’S SALE OF VALUABLE REAL ESTATE
The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated July 12, 2012, and duly recorded in the Office of the Clerk of the County Commission of Ohio County, West Virginia, in Document No. 19462409, in Book No. 1440, at Page 388, Jo Ann Richmond did convey unto Capital Funding Title Agency, LLC, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Wells Fargo Bank, NA to foreclose thereunder, will offer for sale at public auction at the front door of the Ohio County Courthouse in Wheeling, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 08 – Valley Grove District, Ohio County, West Virginia, and more particularly described as follows:
The following parcel of land situate on the northerly side of the National Road (U.S. Route 40), and the easterly side of McGraws Run, Liberty District, Ohio County, West Virginia, and being more particularly bounded and described as follows:
Beginning at a point in the northerly right-of-way line of the National Road (U.S. Route 40) at its intersection with the center line of the McGraws Run Public Road, said point being located N. 28 degrees 26′ W. 2 and 42/100 feet from the most easterly corner of Lot 7, as shown on the plat of Straubdale, said Plat being recorded in the Office of the Clerk of the County Court of Ohio County, West Virginia, in Plat Book 2, at page 87; thence from said beginning point, and with the center line of said McGraws Run Road, which is also the easterly line of said Lot 7, N. 28 degrees 26′ W. 109 and 45/100 feet to a point in the westerly extension of the southerly line of the parcel of land that was conveyed by Zella Straub to Russell Main, by Deed dated November 1, 1926, and recorded in said County Clerk’s Office on Deed Book 207, at page 274; thence leaving the center line of said McGraws Run Road and with said westerly extension and then the southerly lien of said Main property, N. 73 degrees 17′ E. (at 3 and 63/100 feet passing the most southerly corner of the said Main property) 83 and 3/100 feet to a point at the most westerly corner of the said property now or formerly owned by Sara Jane Bursee; thence leaving said Main lands and with the westerly side of the said Bursee tract, S. 25 degrees 43′ E. (at 2 and 31/100 feet passing through a fence post) 107 and 45/100 fee to the northerly right-of-way line of said National Road; thence leaving Bursee lands and with said northerly right-of-way line of the National Road, S. 72 degrees 19′ W. 77 and 64/100 feet to the place of beginning, as the same was surveyed by Stegman & Schellhase, Inc., Civil Engineers and Surveyors.
There is excepted and reserved from the above described parcel so much of the right-of-way for the McGraws Run Road that is included within the boundary line of the Above described parcel. The above-described property is commonly known as:
8631 National Road,
Valley Grove, WV, 26060.
At the time of the execution of the Deed of Trust, this property was reported to have an address of: 8631 National Road, Valley Grove, WV 26060.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $5000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
