PUBLIC NOTICE
OF PROPOSED
ORDINANCE
Pursuant to West Virginia Code Section 8-20-10 notice is hereby given that on the 15th day of August, 2023, the City Council of the City of Wheeling caused to be read an Ordinance setting forth a proposed service change to its water and sewer tariffs currently on file with the Public Service Commission. The proposed Ordinance reads as follows:WHEREAS, the City of Wheeling offers to its water and sewer customers the option of paying their utility bills utilizing credit card and other electronic payments for which it pays a fee to the financial institution for processing of the payment; and
WHEREAS, the City of Wheeling finds it advisable and necessary to revise its current water and sewer tariffs to include a provision to allow the City to recoup the fee charged to it the financial institutions for processing such payments.
THEREFORE, THE CITY COUNCIL OF THE CITY OF WHEELING HEREBY ORDAINS: The following
provision shall be included in its Water Tariff No. 15 and Sewer Tariff No.22 currently on file with the Public Service Commission:
CREDIT CARD AND OTHER ELECTRONIC PAYMENTS
A service charge will be imposed on credit card or other electronic payments. The amount shall be equal to the actual charges to the utility from the financial institution for processing payment. If Wheeling determines to accept other forms of payment, Wheeling will charge customers who elect to use other forms of payment an amount equal to the actual charge that Wheeling incurs to process the customer payment.The rates, fees and charges as set forth above shall become effective 45 days after the enactment hereof. The provisions of this Ordinance are severable, and if any clause, provision or section hereof be held void or unenforceable by the Public Service Commission or any court of competent jurisdiction, such holding shall not affect the remainder of this Ordinance. Upon the effective date hereof, all ordinances, resolutions, orders or parts thereof in conflict with the provisions of this Ordinance are, to the extent of such conflicts, hereby repealed, and to the extent that the provisions of this Ordinance do not touch upon the provisions of prior ordinances, resolutions, orders or parts thereof, the same shall remain in full force and effect.
Upon introduction hereof, the City Clerk shall publish, pursuant to West Virginia Code Section 8-20-10, public notice of this Ordinance as a Class 1-0 legal advertisement in qualified newspapers of opposite politics published and of general circulation in Ohio County, West Virginia, and being of general circulation in the City of Wheeling, and said notice shall state that this Ordinance has been introduced, and that any
person interested may appear before Council on the 5th day of September, 2023, at 5:30 p.m., at City Council Chambers, Room 103, 1500 Chapline Street, Wheeling, West Virginia, which date is not less than one week subsequent to the date of the publication of notice of this Ordinance, and present protests. At such hearing all objections and suggestions shall be heard and the Council shall take such action as it shall deem proper on the premises. Further, said Notice shall advise the public that a copy of this ordinance is available for public inspection at the City Clerk’s Office, 1500 Chapline Street, Suite 303, Wheeling. which is open to the public Monday through Friday during the hours of 9:00 a.m. to 5:00 p.m.
