The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated February 11, 2000, and duly recorded in the Office of the Clerk of the County Commission of Ohio County, West Virginia, in Book No. 1091, at Page 364, Clifford D. Neubauer and Diane L. Neubauer did convey unto George S. Hazlett, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated September 23, 2016 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by FAM Financial Corp. to foreclose thereunder, will offer for sale at public auction at the front door of the Ohio County Courthouse in Wheeling, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Wheeling District, Ohio County, West Virginia, and more particularly described as follows:
PARCEL ONE
The following lot or parcel of land situated on the southwesterly end of Boxwood Circle, Oakmont, City of Wheeling, Triadelphia District, Ohio County, West Virginia, and comprising all of Lot No. 9, as shown on the Plat of Oakmont Hills (Section A), a copy of said plat being recorded in the office of the Clerk of the County Commission of Ohio County, West Virginia, in Plat Book 3, at page 75.
PARCEL TWO
Beginning at the concrete monument at the most northerly corner of Parcel No. 4, conveyed by Jacob H. Kaylor and Louise O. Kaylor, his wife, to Frank M. Hudson, by Deed dated October 31, 1963, and being of record in the office of the Clerk of the County Commission of Ohio County, West Virginia, in Deed Book 450, at page 124, thence with the easterly line of Parcel No. 4 (which is also the westerly line of Lot No. 9, as shown on a Plat of Oakmont Hills, (Section A), and being of record in said County Clerk’s Office in Plat Book 3, at page 75), S. 4* 59′ E., 167.64 feet to a concrete monument; thence with the division line between Parcel No. 4 and Lot No. 3 of Oakmont Hills, S. 82* 59′ 30″ W. 86.05 feet to a concrete monument; thence with the division line between the said Parcel No. 4 and Lot No. 2 of Oakmont Hills, N. 31* 16′ 30″, W. 161.70 feet to a concrete monument in a line referred to as the easterly line of Howard Place in the above mentioned Deed; thence with the southerly line of Parcel No. 1 conveyed to Frank M. Hudson, by the aforesaid Deed dated October 31, 1963, N. 53* 02′, W. 17.29 feet to a cross out in the top of a stone wall of the southeasterly side of Arlington Drive; thence along the southeasterly side of Arlington Drive, N. 28* 22′ E. 21.05 feet to a cross out in the top of the said stone wall, thence crossing through Parcel No. 1 and Parcel No. 3, S. 70* 23′ 20″ E. 133.68 feet to a point on Parcel No. 4; thence N. 30* 36′ E. 64.20 feet to the place of beginning, containing 0.409 of an acre, more or less.
PARCEL THREE
Beginning at a point in the westerly line of Boxwood Circle at its intersection with the division line between Lots 9 and 10 as show on the aforementioned plat; thence from said beginning point, leaving Boxwood Circle, and with said division line between Lots 9 and 10, N. 84* 00′ W. 115 and 76/100 feet to a point at the most northerly corner of Lot 9; thence leaving said Lot 9 and following along the westerly line of Lot 10, N. 37* 08′ 30″ E. 30 and 53/100 feet to a point, said point being located S. 69* 21′ E. 1 and 2/10 feet from a stake; thence crossing through Lot 10, S. 69* 21′ E. 103 and 33/100 feet to the place of beginning, as the same was surveyed by Stegman & Schellhase, Inc., Civil Engineers and Surveyors.
PARCEL FOUR
A parcel of real estate situated in land adjoining Howard Place, in the City of Wheeling, Triadelphia District, Ohio County, West Virginia, and being more particularly described as follows:
Beginning at a point in a northwesterly line of Oakmont Hills (Section A), a plat of the said Oakmont Hills (Section A), is recorded in the office of the Clerk of the County Commission of Ohio County, West Virginia, in Plat Book 3, at page 75, said point being also located S, 36* 58′ W. 103.31 feet, measured along the said northwesterly line of Oakmont Hills (Section A) from the most easterly corner of that parcel of land, containing 1.2 acres, conveyed by Frank M. Hudson and Janet M. E. Hudson, his wife to Donald Charles McLane and Ada Carol McLane by Deed dated April 20, 1970, and being of record in the said County Clerk’s office in Deed Book 514, at Page 128; thence from said place of beginning and with the said northwesterly line of Oakmont Hills (Section A), S. 36* 58′ W. 112.19 feet to a concrete monument; thence with two lines of the said 1.2 acre parcel of land, S. 30* 36′ W. 64.20 feet to a point, and N. 70* 23′ 20″ W. 69.62 feet to a point; thence with two lines crossing through the said 1.2 acre parcel of land, N. 36* 58′ E. 196.76 feet to a point, and S. 53* 02′ E. 59.33 feet to the place of beginning, containing 11,359 square feet of land, more or less.
Being the same property conveyed to Grantor herein by James C. Gardill, Substitute Trustee, by Deed dated July 26, 1993, and recorded in Ohio County Deed Book 673, ate page 751.
At the time of the execution of the Deed of Trust, this property was reported to have an address of: 52 Boxwood Circle, Wheeling, WV 26003.
Said property will be sold subject to that Deed of Trust dated February 11, 2000, and recorded February 16, 2000, in Book 1091 at page 364.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $9000.00 in cash and/or certified funds as deposit with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
