Notice is hereby given that the undersigned Substitute Trustee, appointed by document dated May 9, 2022, and of record in the Office of the Clerk of the Marshall County Commission in Deed of Trust Book 1100, at page 509, will sell at public auction to the highest bidder on:

December 8, 2023, at 10:00 a.m.,

at the front door of the Marshall County Courthouse, 600 Seventh Street, Moundsville, West Virginia, that certain property conveyed by Chadwick Lancaster and Brandy Lancaster, to Ronal W. Rush, original Trustee, by Deed of Trust dated September 28, 2018, and recorded in the office of the said Clerk of the County Commission of Marshall County, West Virginia, in Deed of Trust Book 1034, at page 324, and being described as follows:

Beginning at a point in the eats (sp) line of Grant Avenue and which said point is located twenty-nine (29) feet northeastward from the northwest corner of Lot Number Eight (8) in the M. Popp Addition to Moundsville, West Virginia; thence South 78 degrees 50′ E. 81.4 feet to a stake; thence North 5 degrees 12′ East 39.44 feet to a point; thence North 13 degrees 36′ East 5/56 feet to a stake; thence North 82 degrees 24′ West 77.6 feet to a stake in the eats (sp) line of said Grant Avenue; thence with said line South 11 degrees 10′ West 40 feet to the place of beginning, which said parcel of land is part of Lot Number Seven (7) as shown on the plat of the Mike Popp plane of lots, which is of record in the office of the Clerk of the County Commission of Marshall County, West Virginia, in Deed Book 174, at page 599, and a part of the first parcel described in Deed Book 200, at page 480, as part of tract number fifty-four (54).

Being the same property conveyed to Chadwick Lancaster and Brandy Lancaster, by Darla Furbee, by Deed dated September 5, 2018, and recorded in Marshall County Deed Book 1018, at page 248.

Property Address: 922 Grant Avenue, Moundsville, West Virginia.

The terms of the sale will be as follows: Cash in hand on the day of sale. Sale of said property will be made subject to: (1) All prior exceptions, reservations, rights of way, easements, conditions, covenants, restrictions, leases and other servitudes of record if any pertaining to said real estate; (2) any and all unpaid taxes assessed against said property; (3) the subject property will be sold in “as is” condition; (4) the Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property; (5) the

Substitute Trustee will deliver a Substitute Trustee’s Deed to the purchaser without any covenant or warranty (expressed or implied) in the form prescribed by West Virginia Code Chapter 38-1-6. The Substitute Trustee makes no representations and warranties about the title of the real estate to be conveyed.

Any sale hereunder may be adjourned from time to time without notice other than oral proclamation at the time and place appointed for the sale. The Substitute Trustee reserves the right to reject any or all bids. Additional terms and conditions shall be announced at the sale.

Any sale hereunder in which the property is encumbered by Federal Tax Liens will be subject to the 120-day redemption period pursuant to 26 U.S.C.A. Section 7424(d).
