SUBSTITUTE TRUSTEE’S SALE OF VALUABLE REAL ESTATE

Notice is hereby given that the undersigned Substitute Trustee, appointed by document dated October 3, 2016, and of record in the Office of the Clerk of the Wetzel County Commission in Deed of Trust Book 399 at page 599, will sell at public auction to the highest bidder on:
November 18, at
10:00 a.m.,
at the front door of the Wetzel County Courthouse, 200 Main Street, New Martinsville, West Virginia, that certain property conveyed by Victoria E. Arbogast to Ronal W. Rush, Trustee, by Deed of Trust dated August 30, 2005, and recorded in the office of the said Clerk of the County Commission of Wetzel County, West Virginia, in Deed of Trust Book 317, at page 166, and being described as follows:
The following described property with the appurtenances thereunto belonging, situate in John C. McEldowney’s Second Addition to the City of New Martinsville, Magnolia District, Wetzel County, West Virginia, bounded and described as follows, to-wit:

Beginning at a stake in the west line of Maple Avenue and at the northeast corner of Lot N in said Addition; thence with the north line of said Lot N in a westerly direction 100 feet to a stake in the east line of a 14 foot alley and at the northwest corner of said Lot N; thence in a northerly direction and with the east line of said alley 40 feet to a stake; thence in an easterly direction and parallel with said north line of said Lot N, 100 feet to a stake in the west line of Maple Avenue; thence with said Maple Avenue and in a southerly direction 40 feet to the place of beginning, being a lot 40 feet in width and 100 feet in depth and being the southern part of Lots F and G in said addition and as shown on plat of said addition in the Office of the Clerk of the County Commission of Wetzel County, West Virginia, in Plat Book 1, page 14, to which plat reference is here made for a more particular description of said property.

This conveyance is made subject to all reservations, exceptions, grants of rights of way and easements made by the grantors and their predecessors in title as recorded in the said Wetzel County Clerk’s Office.

Being the same property conveyed to Victoria E. Arbogast by David J. Price & Christine Marie Price, husband and wife, by Deed dated May 15, 2001, and recorded in Wetzel County Deed Book 372, at page 264.

The terms of the sale will be as follows: Cash in hand on the day of sale. Sale of said property will be made subject to: (1) All prior exceptions, reservations, rights of way, easements, conditions, covenants, restrictions, leases and other servitudes of record if any pertaining to said real estate; (2) any and all unpaid taxes assessed against said property; (3) the subject property will be sold in “as is” condition; (4) the Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property; (5) the Substitute Trustee will deliver a Substitute Trustee’s Deed to the purchaser without any covenant or warranty (expressed or implied) in the form prescribed by West Virginia Code Chapter 38-1-6. The Substitute Trustee makes no representations and warranties about the title of the real estate to be conveyed.
Any sale hereunder may be adjourned from time to time without notice other than oral proclamation at the time and place appointed for the sale. The Substitute Trustee reserves the right to reject any or all bids. Additional terms and conditions shall be announced at the sale.
