Proceeding to Determine Whether the City of Paden City and Paden City Municipal Water Works is a
Distressed or Failing Utility.

NOTICE OF PUBLIC COMMENT AND EVIDENTIARY HEARING

On November 3, 2023, the Public Service Commission opened a proceeding to investigate whether the City of Paden City and the Paden City Municipal Water Works (City) is a distressed or failing utility pursuant to the
Distressed and Failing Utilities Improvement Act, W. Va. Code § 24-2H-1, et seq.

The Commission named the City of New Martinsville, City of Sistersville, and Tyler County Public Service
District as parties and potential capable proximate
utilities that could assume operation or ownership of the City necessary.

The Commission will conduct an evidentiary hearing
beginning at 10:00 a.m. on January 11, 2024, at the Paden City Municipal Building, 208 W. Main, Paden City, West Virginia, to address the statutory elements of W. Va. Code § 24-2H-1, et seq., including whether the City is a distressed or failing utility and, if so, whether New Martinsville, Sistersville, or Tyler County Public Service District are capable proximate utilities that could provide services to help the City or take over the
operations of the City. Thereafter, the Commission will hold a public comment hearing beginning at 5:30 p.m. to receive public comments regarding, but not limited to, possible options available to bring the potential
distressed or failing utility into compliance with
appropriate statutory and regulatory standards
concerning actual or imminent public health problems or unreasonable quality and reliability service standards.

Anyone desiring to file a written comment should do so as soon as possible, although comments will be
