By virtue of that certain Deed of Trust made by Trent M. Wolfe and Bria L. Wolfe, to John E. Gompers, Trustee, dated the 25th day of April, 2015, and of record in the office of the Clerk of the County Commission of Marshall County, West Virginia, in Deed of Trust Book No. 960, at page 420, and that certain Appointment of Successor Trustee, dated the 15th day of February, 2024, and of record in the aforesaid County Clerk’s office in Deed of Trust Book No. 1123, at page 238, and in Deed of Trust Book No. 1123, at page 240, the undersigned will sell at public auction, and subject to the terms and conditions set forth in this Trustee’s Notice of Sale and in the said Deed of Trust, on the 2nd day of April, 2024, at 1:30 o’clock P.M., at the rear door (6th Street entrance) of the Court House of Marshall County, Moundsville, West Virginia, the following described property (“Property”) situate on Roberts Ridge, Clay District, Marshall County, West Virginia, and being more particularly described as follows:
Beginning at a stone on the south side of a private road; thence running with the south side of said road, North 56 degrees 57′ West 81.32 feet to Monument “B”, being the northwest corner of the within described tract and being also the northeast corner of “Tract 2”; thence with the east side of Tract 2, South 43 degrees 40′ West 110 feet to a stone, said stone being the southeast corner of Tract 2; thence with land remaining to H.V. Fox, South 46 degrees 20′ East 89.40 feet to a stone on the west side of the Roberts Ridge County Road, said stone being designated as Stone “C”, said stone being located South 57 degrees 16′ West 136.60 feet from Monument “A”; thence running 20 feet west of and concentric with west side of Roberts Ridge County Road northward 140 feet, more or less, to a point; thence with an easterly projection of the north side of the within described parcel, 10 feet, more or less, westerly to aforementioned Monument “A”, said monument being approximately opposite a point in the center of said pavement about 160 feet north of the center line of a culvert, said measurement being with the center line, and said point being located 196 feet in a southerly direction with the center line of said pavement from a point in the center of said pavement at a point opposite a post at the southeast corner of the intersection of “Kull’s Lane” and Roberts Ridge Road; thence running with the south side of said private road, North 56 degrees 57′ West 42.30 feet to the place of beginning, containing 12,549 square feet, more or less.
Being the same property that was conveyed to Trent Wolfe and Bria Wolfe by deed dated the 29th day of June, 2012, and recorded in the Office of the Clerk of the County Commission of Marshall County, West Virginia, in Deed Book 771, page 438.
TERMS OF SALE: Sale of the Property will be made subject to the lien for any and all real estate taxes, whether or not currently due, owing, delinquent or payable, whether paid or are otherwise not currently payable; and further, sale of the subject interest in the Property is subject to any and all other liens, encumbrances, or adverse claims of interest which may be superior to the lien of the Deed of Trust being foreclosed upon or the title of Trustee hereunder, including especially but not limited to the lien arising out of the loan to Trent Wolfe and Bria Wolfe, his wife, secured from Main Street Bank by a Deed of Trust dated the 29th day of June, 2012, and of record in the office of the Clerk of the County Commission of Marshall County, West Virginia, in Deed of Trust Book 901, at page 46. The Property will be conveyed “As Is”, without warranty or representation, express or implied, as to title, physical condition, environmental condition or any other adverse condition which might affect merchantability, marketability, fitness or use of the Property. CASH IN HAND or CERTIFIED FUNDS (Certified Check) in full in the amount of the successful bid or bids on the day of the sale is required for any bidder to purchase the subject Property.
