TRUSTEE’S SALE OF VALUABLE REAL ESTATE
The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated November 10, 2020, and duly recorded in the Office of the Clerk of the County Commission of Ohio County, West Virginia, in Document No. 19723415, in Book No. 1615, at Page 347, William R Hockenberry did convey unto Cara Stazenski, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by PennyMac Loan Services, LLC to foreclose thereunder, will offer for sale at public auction at the front door of the Ohio County Courthouse in Wheeling, West Virginia, on May 24, 2024 at 11:30 AM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 04 Richland Country District, Ohio County, West Virginia, and more particularly described as follows:
The following described tract of land situate on the easterly side of Peters Run Road, Richland District, Ohio County, West Virginia, and being more particularly bounded and described as follows: Beginning at a point in the center line of Peters Run Road; said point being located from the southwesterly corner of the 2 and 73/100 acre tract of land that was conveyed by Clarence W. Nichols, et al. to George E. Paulovichs and Betty C. Paulovichs, by deed dated April 20, 1950, and recorded in the office of the Clerk of the County Commission of the Ohio County, West Virginia, in Deed Book 323, at page 204, the following four (4) bearings and distances: measured along the center line of the traveled part of the said Peters Run Road, S. 06 degrees 53′ W. 21and 28/100 feet to a point; thence S. 12 degrees 23′ W. 40 and 1/10 feet to a point: thence S. 15 degrees 49′ W. and 24/100 feet to a point: thence S. 11 degrees 24′ W. 12 and 64/100 feet to said beginning point; thence from said beginning point and with the southerly line of a roadway, S. 86 degrees 39′ E. 38 E. and 95/100 feet to a stake in the westerly line of a roadway thirty (30) feet wide, hereinafter mentioned; thence with the westerly side of said roadway, Thirty (30) feet wide, the following three (3) bearings and distances: S. 23 degrees 15′ E. 124 and 26/100 feet to a stake; thence S. 32 degrees 53′ E. 202 and 29/100 feet to a stake; thence S. 32 degrees 41′ E. 182 and 48/100 feet to a stake at the most northerly corner of a one (1) and 77/100 acre tract, S. 77/100 acre tract, S. 77 degrees 56′ W. 315 and 67/100 feet to a point in the center line of the traveled part of said Peters Run Road at the northwesterly corner of said one (1) and 77/100 acre tract; thence leaving said one (1) and 77/100 acre tract and with the center line of Peters Run Road, the following seven (7) bearings and distances: N. 03 degrees 21′ W. 117 and 4/10 feet to a point; thence N. 01 degrees 53′ W. 42 and 9/10 feet to a point; thence N. 02 degrees 12′ E. 155 and 9/100 feet to a point; thence N. 01 degrees 34′ E. 80 and 36/100 feet to a point; thence N. 02 degrees 57′ E. 44 and 39/100 feet to a point; thence N. 06 degrees 41′ E. 37 and 3/100 feet to a point; thence N. 11 degrees 24′ E. 30 feet to the place of beginning, containing by survey made by Stegman & Schellhase, Inc. Civil Engineers and Surveyors. One and Ninety-eight Hundredths (1 and 98/100) acres, more or less.
There is also granted to the Party of the second part hereto the right to use the roadway, thirty (30) feet wide, leading from the said Peters Run Road in a southeasterly direction to the most easterly corner of the said 1 and 98/100 ace tract; said right to use said roadway was heretofore granted to the Parties of the First part hereto, their tenants, agents, heirs, executors, administrators, and assigns (Deed Book 391, page 349).
At the time of the execution of the Deed of Trust, this property was reported to have an address of: 117 Nichols Rd, Wheeling, WV 26003.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
