TO: THE CITIZENS OF THE
CITY OF NEW
MARTINSVILLE
NOTICE
You are hereby duly
notified
that pursuant to West
Virginia
Code ยง8-12-5, as
amended,
and Article III, Section 22
entitled Closure and
Abandonment of Streets, Alleys
and Public Ways, of the Code
of the City of New
Martinsville,
West Virginia, the New
Martinsville Planning
Commission shall
consider the
application of landowner, City of New Martinsville, to close and vacate an
undeveloped unnamed
alley lying between
Parkway Drive and 2nd Street in Owen Witten Addition, also know Witten Addition, in the
City of New Martinsville, Wetzel
County, West Virginia
adjacent to and lying between the
following parcels:

Tax Map 16, Parcel 83
identified as Lot 1;

Tax Map 16, Parcel 82
identified as Lot 2;

Tax Map 16, Parcel 80
identified as Part of Lot 3;

Tax Map 16, Parcel 286
identified as 900 Sq Feet; and,

Tax Map 16, Parcel 79
identified as Lot 4 and Lot 5.

The Planning Commission will hold a hearing on the 20 day of May, 2024, at 6 o’clock P.M. at Council
Chambers in New
Martinsville City Building, at which time and place the Planning Commission shallhear any evidence
relating to the use of and rights or claims in or to an unnamed unopened
alley described
hereinabove.
You and/or your attorney
shall be given an
opportunity to be
heard and to make any proper legal defense, after which Planning
Commission shall
make its order pursuant to
law, which may include closing and vacating the aforesaid street
and alley or portions thereof.

A copy of the Application
to Close, Vacate and
Abandon an
Unopened Unnamed Alley lying between Parkway Drive and
2nd Street in Owen Witten
Addition, City of New
Martinsville, can be
obtained
from the City Recorder at the New Martinsville
Municipal
Building.
