TRUSTEE’S SALE OF VALUABLE REAL ESTATE
The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated August 14, 2008, and duly recorded in the Office of the Clerk of the County Commission of Ohio County, West Virginia, in Document No. 1775112, in Book No. 1359, at Page 577 and re-recorded in Document No. 19605903 MOD, in Book No. 1513, at Page 780 and re-recorded in Document No. 19688992 MOD, in Book No. 1574, at Page 288, Andrew R Beckett and Tiffany A Oszust did convey unto Robert Milner, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Selene Finance LP to foreclose thereunder, will offer for sale at public auction at the front door of the Ohio County Courthouse in Wheeling, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 10 – Wheeling District, Ohio County, West Virginia, and more particularly described as follows:
All of Lots Three (3) and four (4) and the northerly part of Lot Two (2) as shown on Fairview Terrace, a Plat of said Fairview Terrace being recorded in the Office of the Clerk of the County Commission of Ohio County, West Virginia, in Plat Book 3, at page 15, and being more particularly bounded and described as follows: Beginning at a concrete monument at the intersection of the division line between Lots One (1) and Two (2) with the southerly line of Fairview Street, as shown on said Plat of Fairview Terrace, said beginning concrete monument being the most easterly corner of the triangular parcel of land that was conveyed by Henry G. Roth and Gertrude Roth to Donald Henry Neumann and Patricia M. Neumann, by Deed dated September 22, 1950, and recorded in said County Clerk’s office in Deed Book 327, at page 464; thence from said beginning concrete monument and with the northerly line of the said Neumann parcel, South 46 deg 29′ 20″ West 83 and 2/100 feet to a point in the northerly line of a lane at the most westerly corner of said Neumann parcel; thence leaving said Neumann parcel and with the said northerly line of a lane North 54 deg 37′ West (hereto erroneously referred to as East) (at thirty-four (34) feet passing the division line between Lots Two (2) and Three (3) and then at eighty- four (84) feet passing the division line between Lots Three (3) and Four (4) 166 and 31/100 feet to a point in the division line, between said Lot Four (4) and Lot Five (5); thence leaving said lane and with said last mentioned division line, North 56 deg 17′ East 92 and 13/100 feat a point in the southerly line of said Fairview Street; thence with a curve to the left having a radius of seventy (70) feet, the following chord bearing and distance South 44 deg 10′ East 25 and 38/100 feel to a point; thence leaving said curve and with the southerly line of said Fairview Street, South 54 deg 37′ East (at 24 and 47/100 feet passing through a concrete monument in the division line between said Lots Four (4) and Three (3) and then at 74 and 47/100 feet passing the division line between said Lots Three (3) and Two (2), 124 and 47/100 feet to the place of beginning.
It is understood and covenanted and agreed that the said party of the second part, his heirs and assigns, shall not suffer or cause the erection within a space of ten (10) feet measured from the front line of the lots hereby conveyed, any building or structure whatsoever, excepting an open porch, piazza or stoop, and it is further covenanted and agreed that no building or structure shall be erected or placed upon the property hereby conveyed, the cost of which shall be less than Five Thousand Dollars ($5,000.00). This conveyance is made subject to exceptions, reservations, restrictions, covenants, conditions, easements and rights-of-way referred to or contained in this Deed, any aforementioned Deeds and all prior conveyances of record.
At the time of the execution of the Deed of Trust, this property was reported to have an address of: 3 Fairview Terrace, Wheeling, WV 26003.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
