IN THE MATTER OF OHIO COUNTY CASE # 24-JA-48 TRISHA ANN MORTAKIS, biological mother of infant R.S., whose date of birth is July 15, 2021, HENRY BURTON, occasional custodian of infant R.S., whose date of birth is July 15, 2021, and ROSHAWN LAMAR SIMMS, biological father of infant R.S., whose date of birth is July 15, 2021. , natural child of Trisha Ann Mortakis. The Petitioner, the West Virginia Department of Health and Human Resources, has filed a petition alleging that TRISHA ANN MORTAKIS and HENRY BURTON have abused and neglected, abandoned, or failed to provide for the care, custody and control of infant R.S., whose date of birth is July 15, 2021. TRISHA ANN MORTAKIS and HENRY BURTON are ORDERED to appear in the courtroom of the Honorable Michael J. Olejasz, Judge of the Circuit Court of Ohio County, West Virginia, Fifth Floor, Ohio County Courthouse, Wheeling, WV on the 16th day of July, 2024, 2024 at 1:00 p.m. for a Preliminary and Adjudication Hearing , if they so desire to object or make other defenses to the Petition; otherwise the removal of R.S. may be affirmed and TRISHA ANN MORTAKIS, biological mother of infant R.S., whose date of birth is July 15, 2021 and HENRY BURTON, occasional custodian of infant R.S., whose date of birth is July 15, 2021, and may be adjudicated as an abusive and neglectful parent and custodian.
