NOTICE OF TRUSTEE’S SALE OF VALUABLE REAL ESTATE
TO: Elza E. & Lori Ann O’Neil

Notice is hereby given that the undersigned Trustee will sell at public auction to the highest bidder on:
August 30, 2024,
at10:30 a.m.,
at the front door of the MarshallCounty Courthouse, 600 Seventh Street, Moundsville, West Virginia, that certain property conveyed by Elza E. O’Neil and Lori Ann O’Neil, his wife, to H. Brann Altmeyer, Trustee, by Deed of Trust dated October 30, 2008, and recorded in the office of the said Clerk of the County Commission of Marshall County, West Virginia, in Deed of Trust Book 835, at page 372, and being described as follows:

The Following described real estate, whose Tax Map Number is 2, Parcel 14, situated in Washington District, Marshall County, West Virginia, and described as follows, to-wit:

Beginning at an iron pipe on the east side of a 30 foot private road at the northwest corner of a 10.378 acre tract of the Marshall County Park and Recreation Board (Deed Book 582, Page 684, Sixth Parcel), thence with the east side of said road N. 17* 56′ W. 94.72 feet to a point; thence N. 32* 34′ W. 159.0 feet to a point, thence leaving said road and running through the lands of Gassaway ( Deed Book 279, at page 81), the following two courses; N. 65* 36′ 40″ E. 335.24 feet to an iron pin, passing through iron pins at 10.0 feet and at 305.24 feet; thence S. 25* 22′ 16″ E. 286.16 feet to an iron pin in the northerly line of the abovementioned 10.378 acre tract; thence with said tract S. 71* 38′ W. 330.0 feet to the place of beginning, containing 2.000 acres, more or less, according to a survey by Chadan Engineering, Inc., in February 2004.

There is also hereby granted the use of a 30 foot right-of-way for ingress, egress, and utilities as shown on a plat recorded in Deed Book 444, at page 179, in the Office of the Clerk of the County Commission of Marshall County, West Virginia.

Being the same property conveyed to Elza E. O’Neil and Lori Ann O’Neil, his wife,from Gertrude Ruth Gassaway, by Deed dated March 12, 2004, and recorded in Marshall County Deed Book 636, at page 194.

The terms of the sale will be as follows: Cash in hand on the day of sale. Sale of said property will be made subject to: (1) All prior exceptions, reservations, rights of way, easements, conditions, covenants, restrictions, leases and other servitudes of record if any pertaining to said real estate; (2) any and all unpaid taxes assessed against said property; (3) the subject property will be sold in “as is” condition; (4) the Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property; (5) the Trustee will deliver a Trustee’s Deed to the purchaser without any covenant or warranty (expressed or implied) in the form prescribed by West Virginia Code Chapter 38-1-6. The Trustee makes no representations and warranties about the title of the real estate to be conveyed.

Any sale hereunder may be adjourned from time to time without notice other than oral proclamation at the time and place appointed for the sale. The Trustee reserves the right to reject any or all bids. Additional terms and conditions shall be announced at the sale.

Any sale hereunder in which the property is encumbered by Federal Tax Liens will be subject to the 120-day redemption period pursuant to 26 U.S.C.A. 7424(d).
