ORDER OF PUBLICATION

This action seeks partition of certain coal interests
within and underlying a certain tract of land consisting of approximately 0.1875 gross acres, more or less, located in Grant District, Wetzel County, West Virginia (the
“Subject Coal”) pursuant to West Virginia Code Section 37-4-1 et seq . The surface estate overlying the Subject Coal is identified by the Wetzel County Assessor’s
Office as Tax Map 30, Parcels 15.1, 39.1, and 39.2.
It appearing by affidavit filed in this action that
Plaintiff Harrison County Coal Resources, Inc. (“HCCR”) has exercised due diligence to ascertain the residences or whereabouts of Defendants Norman Vernon Meredith Jr.; Mary Lou Meredith-Myles; Judith Ahmad f/k/a Judith A. Rummel; George Milanovic and/or his unknown
heirs; Glenis I. Miller f/k/a Glenis Fleshman f/k/a Glenis
Barker and/or her unknown heirs; Lester F. Tresize;
Carmine Tresize; and Connie Saleh a/k/a Constance
Ann Saleh, who each own certain interests in the
Subject Coal, and has attempted to achieve service of
process upon them pursuant to West Virginia Rules of Civil Procedure 4(d)(1)(A), 4(d)(1)(C), and/or 4(d)(1)(D), without effect, and therefore desires to achieve service of process upon said Defendants by publication
pursuant to West Virginia Rule of Civil Procedure
4(e)(1)(C) and 4(e)(1)(E) as there may be persons,
other than those named in the Complaint as defendants, with interests in the Subject Coal of this action, whose names are unknown to HCCR and who are made
defendants by the general description of the unknown heirs.
Accordingly, it is hereby ORDERED that
Defendants Norman Vernon Meredith Jr.; Mary Lou
Meredith-Myles; Judith Ahmad f/k/a Judith A. Rummel; George Milanovic and/or his unknown heirs; Glenis I. Miller f/k/a Glenis Fleshman f/k/a Glenis Barker and/or her unknown heirs; Lester F. Tresize; Carmine Tresize; and Connie Saleh a/k/a Constance Ann Saleh, and any and all parties who claim an interest in the Subject Coal must appear and serve upon Plaintiff Harrison County
Coal Resources, Inc.’s counsel, Roger S. Christenson II, Stephenee R. Gandee, and Timothy M. McKeen of the law firm of Steptoe & Johnson PLLC, whose address is 400 White Oaks Boulevard, Bridgeport, West Virginia 26330, an Answer or other defense to the Complaint filed in this action by October 4, 2024, which is not fewer than thirty days after the date of the first publication of
this notice, otherwise judgment by default will be
rendered against him or her at any time thereafter.
A copy of the Complaint can be obtained from the Circuit Clerk’s office in the Wetzel County Courthouse located at 200 Main Street, New Martinsville, West
Virginia 26155.
