TRUSTEE’S SALE OF VALUABLE REAL ESTATE
The undersigned Substitute Trustee, by virtue of the authority vesting in it by that certain Deed of Trust recorded on March 14, 1996, in the Office of the Clerk of the County Commission of Ohio County, West Virginia, in Book 1009 at Page 547, and modified by Court Order recorded on October 19, 2021 in Book 1639 at Page 638, Kathleen J. Crockard and Edward L. Crockard did convey unto Douglas C. McElwee, as Original Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Elk River Trustees Inc., as Substitute Trustee by virtue of a Substitution of Trustee recorded on October 3, 2024, in Book 1693 at Page 471 in the aforesaid Clerk’s Office; the undersigned Substitute Trustee has been requested, in writing, by the beneficiary of said Deed of Trust to sell the real estate described below, as there has been a default under the terms and conditions of said Deed of Trust. Therefore, the undersigned Substitute Trustee having been instructed by U.S. Bank National Association, as Trustee, as successor to Firstar Trust Company, as Trustee, for Manufactured Housing Contract Senior/Subordinate Pass-Through Certificate Trust 1996-4 to foreclose thereunder will offer for sale, at a public auction at the front door of the Ohio County Courthouse in Wheeling, West Virginia, on

the following described real estate, together with its easements, improvements, and appurtenances thereunto belonging, situate in Liberty District, Ohio County, West Virginia, and more particularly bounded and described as follows:
LEGAL DESCRIPTION
The following parcel of land is situate on the westerly side of the Covenanter Church Road (State Secondary Route 41/3), and the southerly side of the Valley Grove and Middle Wheeling Creek Road (State Secondary Route (41/4), Liberty District, Ohio County, West Virginia and being more particularly bounded and described as follows:
Beginning at a point at the intersection of the centerline of the Covenanter Church Road with the Valley Grove and Middle Wheeling Creek Road; thence from said beginning point and with the centerline of the Covenanter Church Road the following four (4) bearings and distances; S. 32 deg 49′ 36″ W. 40 and 18/100 feet to a point; thence S. 37 deg 06′ W. 40 and 04/100 feet to a point; thence S. 39 deg 24′ W. 55 and 01/100 feet to a point; thence S. 40 deg 41′ W. 16 and 23/100 feet to a point located N. 40 deg 40′ 40″ E. 16 feet and N. 40 deg 41′ E. 32 and 77/100 feet from the most easterly corner of the 1 and 474/1000 acre parcel of land which was conveyed by Erin Homes, Inc. to June M. Hester: by deed dated October 6, 1982 and ,recorded in the Office of the Clerk of the County Court of Ohio County, West Virginia in Deed Book 608 at Page 443; thence leaving said road and crossing through other property now owned by the party of the first part hereto, the following two (2) bearings and distances: N. 53deg 26′ 21″ W. (at 14 and 85/100 feet passing an iron pin) 268 and 62’100 feet to an iron pin; thence N. 32 deg 10′ 33″ E. (at 32 and 57/100 feet passing an iron pin) 55 and 1/10 feet to a point in the centerline of the Valley Grove and Middle Wheeling Creek Road; thence with said centerline the following four (4) bearings and distances: S. 88 deg 20′ 40″ E. 86 and 6/10 feet to a point; thence S. 70 deg 54′ 20″ E. 88 and 02/100 feet to a point; thence S. 68 deg 50′ E81 and 84/100 feet to a point; thence S. 50 deg 06′ 35″ E. 40 and 75/100 feet to the place of beginning containing seven hundred and sixty-three one thousandths (763/1000) acres. more or less, by survey made by Stegman & Schellhase, Inc., Civil Engineers and Surveyors, Wheeling, West Virginia on August 24, 1990.
The above described 763/1000 acre parcel of land is subject to those parts of the rights of way for the said Covenanter Church Road and the said Valley Grove and Middle Wheeling Creek Road that are included within the boundary lines of said 763/1000 acre parcel of land.
The said 763/1000 acre parcel of land is subject to any and all conditions, exceptions, reservations, stipulations, rights of way, etc. as may be contained in former deeds.
At the time of the execution of the subject Substitution of Trustee, the property was reported to have an address of: 2157 W Alexander Road, Valley Grove WV 26060 .
The above referenced real estate will be conveyed with no covenants of warranty and subject to any and all easements, rights of way, conditions, covenants, restrictions, exceptions, reservations, leases and other servitudes, which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground. The sale of the referenced real estate will also be subject to all prior liens and including any and all other deeds of trust, judgments, liens, and all other encumbrances of any nature whatsoever, if any, having priority over the subject Deed of Trust.
The subject property will be sold in an “AS IS” condition. The Substitute Trustee makes no representations and warranties of any kind or character including, but not limited to, the condition of the real estate or the title to the real estate to be conveyed. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
In the event that there are federal tax liens against the property, the United States has the right to redeem the property within a period of one hundred twenty (120) days from the date of the sale. The Substitute Trustee reserves the right to adjourn the sale for a time, or from time to time, without further notice, by announcement at the time and place of the foreclosure sale described herein.
TERMS OF SALE

1. $4,000.00 (Four Thousand Dollars) in cash and/or certified funds made payable to “Elk River Trustees, Inc.” due as a deposit at the time of sale, with the balance due and payable within thirty (30) days of sale. Personal checks will not be accepted.
2. The purchaser at the sale shall be responsible for payment of all real estate taxes.
3. The purchaser shall be responsible for payment of the recording cost of the deed and also for payment of the tax on the privilege of transferring the real property (transfer tax) imposed by West Virginia Code Section 11-22-2.
4. The parties secured by the Deed of Trust reserve the right to purchase the property at the foreclosure sale.
