Activity:
To operate and maintain an existing combined wastewater collection system and an existing 9.0 million gallons per day wastewater treatment plant. Facilities are to serve a population equivalent of approximately 90,000 persons in the City, the Town of Barrackville, the Town of Monongah, Kingmill Valley Public Service District, Greater Paw Paw Public Service District, Whitehall Public Service District, and environs, and discharge treated wastewater through Outlet No. 001 to the Monongahela River at Mile Point 125.5. An antidegradation review has been conducted. Tier 1 protection is provided for the uses specified in Title 47, Series 2, Section 6 for Outlet No. 001. Also, to operate and maintain disposal systems, best management practices, and the nine (9) minimum controls for the direct discharge of sanitary wastewater and storm water from Combined Sewer Overflow (CSO) Outlet No. C003 to Goose Run; Outlet Nos, C005, C007, C010, and C049 to the West Fork River; Outlet No. C004 to Rheas Run; Outlet No. C044 to an Unnamed Tributary; Outlet No. C045 to the Tygart Valley River; Outlet Nos. C012, C013, C014, C015, C018, C025, C027, C028, C029, C030, C039, C043, C046, C047, and C048 to the Monongahela River; Outlet Nos. C016, C017, C018, C034, and C042 to Coal Run; Outlet Nos. C023, C024, and C041 to Buffalo Creek; and Outlet Nos. C031, C032, and C038 to Hickman Run. These outlets are to discharge only when the hydraulic capacity of the collection system is exceeded during wet weather events. Tier 1 protection shall be afforded for the uses specified in 47 CSR 2 for the CSO outfalls through implementation of the facility’s Long-term Control Plan. To implement a Publicly Owned Treatment Works Pretreatment Program. Also, to incorporate the requirements relative to Title 33, Series 2 of the West Virginia Legislative Rules for the processing and disposal of sewage sludge generated by the wastewater treatment plant. Sewage sludge generated and/or processed at the permittee’s facility shall be land applied, provided that the sewage sludge shall not be applied in a manner the exceeds the agronomic or lifetime loading rates. These land application site(s) meet all other regulatory standards and are identified as follows: Kenneth Bragg, located at Ministers Run Road, Rivesville, WV; Lillian Parker, located at McCurdysville Pike, Rivesville, WV; Michael King, located at Layman School Road, Fairmont, WV; Joseph and Rhonda Plum, located at Bunners Ridge Road, Fairmont, WV; Michael Smith, located at Mudlick Road, Fairmont, WV; and Donald Martin, located at Ices Run Road, Fairmont, WV. Further, sewage sludge generated and/or processed at the permittee’s facility shall be disposed of at a sanitary landfill by placing the sewage sludge in the landfill cell. Also, to allow the discharge of untreated storm water runoff at the wastewater treatment plant site through Outlet Nos. 002, 003, and 004 to the Monongahela River. Compliance with the antidegradation requirements is attained through the implementation of Best Management Practices.

Implementation: Compliance with the Combined Sewer Overflow implementation requirements shall be attained through Administrative Order No. 6616, and any amendments, thereto.
On the basis of review of the application, the “Water Pollution Control Act (Chapter 22, Article 11-8(a)),” and the “West Virginia Legislative Rules,” the State of West Virginia will act on the above application.
Any interested person may submit written comments on the draft permit and may request a public hearing by addressing such to the Director of the Division of Water and Waste Management within 30 days of the date of the public notice. Such comments or requests should be addressed to:

The public comment period begins April 18, 2019 and ends May 18, 2019.
Comments received within this period will be considered prior to acting on the permit application. Correspondence should include the name, address and the telephone number of the writer and a concise statement of the nature of the issues raised. The Director shall hold a public hearing whenever a finding is made, on the basis of requests, that there is a significant degree of public interest on issues relevant to the Draft Permit(s). Interested persons may contact the public information office to obtain further information.
The application, draft permit and any required fact sheet may be inspected, by appointment, at the Division of Water and Waste Management Public Information Office, at 601 57th Street SE, Charleston, WV 25304-2345, between 8:00 a.m. and 4:00 p.m. on business days.
